
(Patria) - Failure to enforce judgments of the European Court of Human Rights or proposing laws that are not in line with these judgments is a criminal offense. Therefore, on 27.02.2024, I filed a criminal complaint against Dragan Čović, due to reasonable suspicion that he committed the criminal offense: “Non-enforcement of a decision of the European Court of Human Rights” under Article 239, in conjunction with the criminal offense of “Incitement” under Article 30 of the Criminal Code of Bosnia and Herzegovina, stated the introducer of today's session of "Krug 99", Azra Zornić.
"On 19.8.2024, I received an Order not to conduct an investigation in which the acting prosecutor states that it is not a criminal offense! The reported person, as a responsible and official person, and also as the chairman of the citizens' association HNS, incited others and himself knowingly, with direct intent, participated in proposing amendments to the Election Law of BiH, which prima facie are not in line with the decisions of the European Court of Human Rights. Therefore, by gross neglect and abuse of official position, the defendant committed the criminal offense defined in the Criminal Code of BiH", adds Zornić.
As she says, the acting prosecutor in her explanation provides arguments that represent an incorrect and arbitrary determination of the facts. 1. Citing the decision of the Constitutional Court of Bosnia and Herzegovina U-14/22, which found that the Proposal for the Law on Amendments to the Election Law of Bosnia and Herzegovina did not violate the vital interest of the Bosniak people!?
"The prosecutor incorrectly determined the facts and, by making a presumption, grossly violated my fundamental freedoms. Namely, from the ECHR judgment, it can be seen that I filed the lawsuit as a citizen of Bosnia and Herzegovina, not as a member of any 'constituent people'.
"Building a modern democratic state of BiH implies the enforcement of all ECHR judgments. A long-term obstruction of their enforcement is evident. Special attention should be paid to the currently ongoing intense obstruction of the confirmation of the judgment in the case of Dr. Slaven Kovačević before the Grand Chamber of the ECHR. In this anti-state obstruction, the so-called 'Troika' also participates as part of the ruling coalition. By agreeing to the illegal appointment of BiH agents before the ECHR, politicians from the so-called Troika have placed themselves in the service of the retrograde and anti-European policy of the HDZ. In this, they received support from the Prime Minister of Croatia during his recent visit to Sarajevo, who, with his statement regarding all ECHR judgments, grossly interfered in the internal affairs of BiH", concluded Zornić.
