KS Prosecutor's Office will not investigate: ACM ventilators at KCUS did not worsen health or cause patient deaths

(Patria) - Following detailed checks and analysis of collected evidence, extensive material documentation, and expert findings, the acting prosecutors of the KS Prosecutor's Office have decided that an investigation will not be conducted against Sebija Izetbegović, Amela Katica Mulalić, Senita Beharić, Ilijasa Aslanija, Edibe Čelić Spužić, Aide Ćorić, Selme Bavčić, Fadila Novalića, Vjekoslava Mandića, Anisa Ajdinovića, and Nijaza Uzunovića, who were reported in connection with the use of ventilators at the University Clinical Center Sarajevo, the KS Prosecutor's Office announced.

"This decision followed the collection of over 10,000 pieces of material evidence from 15 different institutions, including two international requests and a request for legal assistance from the Prosecutor's Office of BiH. More than 50 witnesses were heard, four on-site investigations were conducted, two of which were at the Special Respiratory Center of KCUS. Nine specialist expert examinations were conducted by the Forensic Medicine Board of the Faculty of Medicine in Belgrade.

Medical documentation from KCUS for 2,600 patients treated for COVID 19 was seized. Information was obtained from other hospitals in FBiH regarding the use of ACM 812 A ventilators, as well as data from the Public Health Institute of FBiH on the percentage of infected, recovered, and deceased patients from coronavirus from January to May 2021. The KS Prosecutor's Office determined the potential consequences of using ventilators in the Special Respiratory Center in the treatment of patients with COVID 19. Therefore, this judicial institution did not deal with the procurement or quality of the aforementioned ventilators, which was the subject of proceedings before the Prosecutor's Office and the Court of BiH, but exclusively with the method of use in patient treatment and potential consequences.

Ultimately, the KS Prosecutor's Office determined that the use of ventilators cannot be linked to the worsening of health or the death of any patient. In the mentioned case, certain investigative actions were carried out under the supervision of the acting prosecutors by investigators from the State Investigation and Protection Agency.

Otherwise, the complainants have the right to appeal this prosecutorial decision to the Office of the Chief Cantonal Prosecutor," it was announced.
