
(Patria) - The Union of the State Investigation and Protection Agency (SIPA) and the Union of the Service for Foreigners' Affairs of BiH today submitted an initiative to the Constitutional Court of Bosnia and Herzegovina for a constitutional review of Article 7, paragraphs (4) and (5) of the Law on Salaries and Allowances in BiH Institutions.
"The aforementioned provisions stipulate that, in case the budget of BiH institutions is not adopted, the increased base for salary calculation shall not apply, thus placing employees in BiH institutions in an unfavorable and discriminatory position.
We believe that this violates:
- the right to equality before the law (Article II/4 of the BiH Constitution),
- the right to property (as the salary due to employees is reduced),
- the principle of legal certainty and the rule of law.
Budgetary or political impasses must not be a basis for denying acquired employment rights," stated these two unions in their press release.
