Indictment Confirmed Against Senaid Memić and Five Employees of Ilidža Municipality

(Patria) - The Sarajevo Canton Prosecutor's Office has filed, and the Cantonal Court has confirmed, an indictment against former Ilidža Municipality Mayor Senaid Memić, Ljiljana Eterović, a legal affairs expert associate in the Spatial Planning Service, Adnan Ćenanović, Azra Mulaosmanović, urbanism expert associates, and municipal construction inspectors Amir Arnautović and Sanja Čizmedžić. All six defendants are charged with the criminal offense of abuse of position or authority.

Defendant Senaid Memić is charged with, together with the other defendants, employees of the Ilidža Municipality, from 2015 to 2017, after initially issuing an urban planning consent to the investor of the residential-commercial building "Panamera" for the construction of a building including a ground floor and four floors in accordance with planning documents, at the investor's request, in March 2015, enabling the construction of seven floors, although according to the Regulatory Plan and existing laws, construction of up to four floors was permitted. In this way, defendant Senaid Memić obtained property benefit for the investor "Panamera" in the amount of 9,944,000 KM, as well as illegal benefit in the form of unimpeded construction of additional residential space intended for sale.

Defendants Ljiljana Eterović, Adnan Ćenanović, and Azra Mulaosmanović, as officials of the Spatial Planning Service, acted on the instructions of defendant Memić and prepared illegal permits which he ultimately signed, while construction inspectors Amir Arnautović and Sanja Čizmedžić failed to carry out control of the construction and urban planning Decisions that should have been declared null and void.

The same modus operandi was applied by the defendants in the case of the investor "Malak Group". Specifically, defendant Memić enabled the illegal construction of a seven-story hotel, although the Regulatory Plan permitted construction of up to four floors. In this way, the investor "Malak Group" obtained illegal benefit in the amount of 14,097,472 KM, as well as the benefit of constructing additional commercial space.

At the same time, the defendants are charged with enabling the owner of the catering establishment Bistro "Brajlović" in Ilidža to illegally construct and use parking space in the zone of the Željeznica river, directly adjacent to the catering facility, contrary to regulations on protection against harmful effects of water. The prosecuting attorneys in the indictment proposed the confiscation of property benefit from the legal entity "Panamera" in the amount of 9,944,000 KM and from the legal entity "Malak Group" Sarajevo in the amount of 14,097,472 KM. A temporary measure prohibiting the alienation and encumbrance of part of the real estate in the residential-commercial building "Panamera" and the entire hotel "Malak Group" has been imposed.

For defendant Senaid Memić, a ban on performing duties as a responsible person in state service, public enterprises, or any other legal entity for a period of 10 years from the finality of the verdict has been proposed.

For the main trial, the hearing of 38 witnesses, architectural experts, and the presentation of more than 400 pieces of material evidence has been proposed. The filing of the indictment against the mentioned individuals was preceded by a complex investigation by the Sarajevo Canton Prosecutor's Office in cooperation with the Ministry of Internal Affairs of Sarajevo Canton.
