RS National Assembly Adopts Draft of New Constitution

(Patria) - The RS National Assembly adopted the Draft of the new RS Constitution tonight by a vote of the ruling majority.

The Law on Protection of the Constitutional Order of RS was also adopted, which was submitted to the procedure as an urgent matter at the proposal of the President of RS. It will enter into force the day after its publication in the "Official Gazette of RS".

The Draft Constitution of RS contains a series of radical and unconstitutional provisions stipulating that RS has the right to self-determination, that it decides sovereignly, and that it has the right to freely exit agreements at the BiH level, writes Faktor.

Furthermore, it stipulates that laws that are not within the exclusive jurisdiction of BiH or that do not arise from agreements between entities do not produce legal effect in RS, and that laws passed by the BiH Parliament will not be applied on the territory of RS until they are confirmed by the RS National Assembly.

It also stipulates the formation of the RS army, while abolishing the Council of Peoples, the Vice-Presidents of RS, and removing the concept of constituent peoples from the RS Government.

Additionally, a conclusion on arbitration for dispute resolution was accepted, at the proposal of the Speaker of the RS National Assembly.

Following the adoption of the Draft of the new RS Constitution, a public debate on this document will follow, lasting for 30 days.

Regarding the Law on Protection of the Constitutional Order of RS, apart from a few opposition deputies, no deputies from the ruling majority came forward for discussion.

The head of the Justice and Order Club, Nebojša Vukanović, assessed this law as the "peak of madness" and asked the SNSD deputies if anyone opposed this legal solution and if they had even read it.

This law states that it "is adopted with the aim of effective protection of the constitutional order of RS".

It applies to the detection and criminal prosecution of 21 criminal offenses, namely: attack on the constitutional order; endangering territorial integrity; placing RS in a subordinate or dependent position; murder of representatives of the highest bodies; kidnapping of highest representatives of RS; armed rebellion; prevention of fighting against the enemy; service in a foreign army; aiding the enemy; illegal formation of paramilitary and paramilitary police forces; undermining the defense capability of RS; sabotage; espionage; disclosure of RS secrets; dispatching and transferring armed groups, weapons, and ammunition to the territory of RS; incitement to violent change of the constitutional order; aiding the perpetrator after the commission of a criminal offense against the constitutional order; creation of a group or organized criminal group for the commission of criminal offenses against the constitutional order of RS; disrespect or non-fulfillment of decisions of institutions or bodies of RS; and other criminal offenses that directly or indirectly endanger the constitutional order and territorial integrity of RS.

This law also provides for the formation of a special prosecutor's office, while the chief and other special prosecutors are appointed by the RS National Assembly, as well as the establishment of a special court of RS.

Two amendments from the SNSD deputies' club were also adopted, which stipulate the establishment of a service for the protection of the constitutional order of RS, which will have a director appointed by the President of RS.

The second amendment relates to ensuring that judges of the special court have the necessary number of professional associates and support staff.

The formation of a special detention unit within the KPZ Tunjice in Banja Luka for future suspects of such criminal offenses is also foreseen.
