Zvizdić files appeal to the Constitutional Court of BiH: Minister of Justice of RS Miloš Bukejlović committed a criminal offense

(Patria) - Chairman of the House of Representatives of the Parliamentary Assembly of BiH Denis Zvizdić submitted a request to the Constitutional Court of BiH to resolve a dispute between the state of BiH and the entity of RS, i.e., the entity's Ministry of Justice, and requested the adoption of an interim measure.

"The request was submitted in connection with the disputed Rulebook on the procedure for candidacy and election of the first members of the High Judicial and Prosecutorial Council of RS, which, de facto, aims to put the HJPC of RS into operation and which clearly acts pro futuro in relation to the decision of the Constitutional Court of BiH, which, upon my request for a constitutionality review, on March 7, 2025, adopted a Decision on an interim measure completely suspending the application of the Law on the HJPC of RS, as well as all further legal actions related to that Law," Zvizdić announced on social media.

He also said he expects the Constitutional Court to make a decision on the interim measure as soon as possible to suspend the application of the disputed Rulebook, or to establish that this rulebook is not in force because the application of the Law on the HJPC of RS has been suspended.

He stated that, in addition to the Constitutional Court, the Prosecutor's Office of BiH should also react.

"This is about the need for swift action by the Constitutional Court of BiH and the institutions of BiH to preserve the principles of constitutionality and the rule of law in BiH. It is also important to emphasize that the Minister of Justice of RS, Miloš Bukejlović, by adopting the aforementioned rulebook, committed the criminal offense under Article 239 of the Criminal Code of BiH, 'Failure to enforce decisions of the Constitutional Court of BiH,' and in that regard, with the aim of protecting the rule of law, I expect a reaction from the Prosecutor's Office of BiH, and consequently from other competent institutions," Zvizdić stated.
