
(Patria) - Azra Zornić, one of the victims of human rights violations in Bosnia and Herzegovina, has been fighting the system for 19 years. It is also 10 years since the final judgment in Strasbourg that she won. Today, at Krug 99, she speaks precisely on that topic and the spin about BiH's progress on the path to the EU.
"All human beings are born free and equal in dignity and rights, states Article 1 of the UN Universal Declaration of Human Rights from December 1948.
This UN resolution, through its 30 articles, provided us with a socio-legal norm that served as the foundation for an international treaty - the European Convention for the Protection of Human Rights and Fundamental Freedoms from 1950, which was later supplemented by 12 Protocols. The Convention established the European Court of Human Rights in Strasbourg (Article 19). States parties to the Convention undertake to comply with the final judgment of the European Court in any case to which they are parties, and the responsibility for the application of the Convention is shared by the Court and the Committee of Ministers, which is responsible for supervising the execution of the European Court's judgments. BiH ratified the Convention with all protocols in 1997.
With this introduction, I wanted to emphasize BiH's responsibility for implementing all judgments of the ECtHR. Therefore, legally speaking, there is no obstacle, nor should there be any, to the implementation of the mentioned judgments. In July this year, it will be a full 10 years since the judgment in the case Zornić v. BiH was delivered. All these 10 years, ethno-national-chauvinists, through their political activities, or rather the abuse of their political power, with the wholehearted help of neighbors from Croatia and Serbia, who aspire to the sovereignty and territorial integrity of BiH, have prevented any attempt to implement my judgment.
Christian Schmidt, in the role of High Representative responsible for the civilian aspect of the Dayton Peace Agreement, abuses his position and, at the behest of Plenković, obstructs any attempt to implement my judgment. He does not even try to hide his servile attitude towards the Prime Minister of the Republic of Croatia; on the contrary, on the OHR website and in the media, he boasts of his subservient relationship with Plenković and Vučić. Has the time come to appoint a new High Representative who will perform this duty to the full capacity in the interest of BiH and all its citizens?
After 19 years of my struggle, I will not give up on the judicially won right to be allowed to be, by nationality, a Bosnian without ethnic or any other affiliation, because I believe that is a personal and private choice of every individual in our homeland. In this, I receive great support and help from our diaspora, especially the association from Brussels called GratiArtis, which initiated an online meeting with the Delegation for Relations with Kosovo and BiH at the European Parliament.
My struggle continues through communication with the Committee of Ministers responsible for supervising the execution of ECtHR judgments, from which I will ultimately demand that it resort to a radical proposal for the exclusion of BiH from the Council of Europe! These spins about BiH's progress on the path to full EU membership aim to serve the pre-election campaign of both European Parliament members in June this year and domestic politicians who are preparing in this way for the October municipal elections.
I continue my struggle on the domestic front as well, by filing a series of criminal complaints against persons in charge and responsible for the non-implementation of ECtHR judgments. As a legalist, I believe in our prosecution and judiciary that they will do their job in accordance with the law and the Convention," said Zornić.
