MINISTRY OF SECURITY OF BIH PROPOSED THAT GALIĆ BE DISMISSED AT HIS OWN REQUEST TO ACCOMMODATE THE FUGITIVE!?

(Patria) - The saga of dismissing the fugitive Deputy Director of SIPA, Zoran Galić, will likely not end even at tomorrow's session of the Council of Ministers of BiH.

Although a conclusion was adopted at the last session to prepare an act regarding Zoran Galić's status by the next session, that item is not on the published agenda.

As Patria has learned, the Ministry of Security of BiH, headed by Nenad Nešić, has prepared an act proposing his dismissal at his own request, effective July 8, 2024.

Therefore, the Ministry of Security of BiH has accommodated the request of a fugitive from BiH justice, who, through his legal team, submitted a request for early dismissal due to meeting the conditions for retirement.

When Galić's initial request arrived before the Council of Ministers of BiH, ministers of Bosniak nationality did not wish to support such a solution, and another possibility for his dismissal was sought.

As of July 8, Galić has no justification for his absence from work, and after failing to obtain sick leave and then annual leave, he requested early dismissal.

At today's session of the House of Representatives of the BiH Parliament, the Minister of Justice, Davor Bunoza (HDZ BiH), stated that the Law on SIPA applies in this case, and the Law on Labor in BiH Institutions cannot be applied.

According to the Law on SIPA, Article 7 specifies that "The Council of Ministers dismisses the Director and Deputy Director according to the conditions and procedures implemented by the Independent Board." It further states:

"The Director and Deputy Director may be dismissed before the expiry of their term:

a) at their own request;

b) if a final decision has imposed a disciplinary measure for a serious breach of duty;

c) if convicted of a criminal offense, except for a criminal offense related to traffic safety;

d) if it is determined that they are an active member of a political party;

e) if, based on the opinion of the competent health institution, it is determined that they are permanently unable to perform their duties."

In this case, which is already straining relations within the coalition, given that Galić is a long-time HDZ cadre, the Independent Board of the BiH Parliament has not distinguished itself either. They have not conducted disciplinary proceedings, nor have they clearly initiated Galić's dismissal to the Council of Ministers of BiH. There are also obstructions within the Independent Board by members of Croat nationality who clearly do not want to adhere to law and justice in Galić's case.

Thus, for three months, a person for whom an Interpol red notice has been issued has been in the position of deputy in a state police agency.

Although BiH requested Galić's extradition from the Republic of Croatia, Croatia refused to extradite Galić as he has dual citizenship.

Incidentally, the BiH Prosecutor's Office suspects Galić of abuse of position and accepting a bribe while he was the Director of the BiH Border Police. As announced by the BiH Prosecutor's Office, Galić illegally crossed the border between BiH and Croatia on July 8, where he remains to this day.
