Labour Law before the Constitutional Court of the Federation of Bosnia and Herzegovina

Delegates of the Social Democratic Party of Bosnia and Herzegovina, the Democratic Front and Our Party in the House of Peoples of the Parliament of the Federation of Bosnia and Herzegovina initiated today before the Constitutional Court of the Federation of Bosnia and Herzegovina a dispute regarding the procedure for adopting the Labour Law. The dispute was initiated by 17 delegates of the House of Peoples, reports the Patria news agency.

The proposal of the Labour Law in regular procedure was considered and adopted at the session of the House of Peoples held on July 30, 2015. By violating the Rules of Procedure of the House of Peoples of the Parliament of the Federation of Bosnia and Herzegovina and the Constitution of the Federation of Bosnia and Herzegovina by the leadership of the House, the delegates of the House of Peoples were denied the right to submit amendments to the proposed law, thus the fundamental democratic procedure for adopting laws guaranteed by the Constitution of the Federation of Bosnia and Herzegovina was not respected.

This is precisely the subject of the Request for resolving this constitutional dispute. The dispute concerns relations within the House of Peoples of the Parliament of the Federation of Bosnia and Herzegovina, and the violation of the basic democratic rights of delegates in that House, so that when adopting an extremely important law, they cannot use the democratic procedure and their rights in its adoption, due to which one can no longer speak of a “democratically adopted law”.

We believe that the Constitutional Court of the Federation of Bosnia and Herzegovina, as in similar previous cases, will rule that no acts adopted in violation of the Rules of Procedure of the highest legislative institutions and the Constitution of the Federation of Bosnia and Herzegovina can be applied and must be annulled.
