The news that members of the State Investigation and Protection Agency (SIPA), acting on the order of the Court of Bosnia and Herzegovina, are conducting a search of the Case Management System (CMS) related to the cases of the Court of Bosnia and Herzegovina has once again proven that nothing in the BiH judiciary functions as it should.
The High Judicial and Prosecutorial Council, where SIPA is conducting the search, in its statement, while shifting responsibility from itself, as they usually do, notes that this search does not pertain to the entire system, but exclusively to, as stated, the Court of Bosnia and Herzegovina.
So, the citizens of Bosnia and Herzegovina should breathe a sigh of relief, because, as with others, primarily referring to the BiH Prosecutor's Office, there are no problems regarding the CMS, which is a blatant lie, given that former Chief Prosecutor Gordana Tadić ended up on the US blacklist precisely due to abuses of the CMS system!
But the VSTV has never seriously addressed this issue, nor resolved the problem, so the news that SIPA is searching only the system related to the BiH Court is no consolation.
And just recently, specifically on July 24, the legal team of Fadil Novalić filed a criminal complaint against Gordana Tadić, and lawyer Elmir Jahić emphasizes that the murky games surrounding the CMS are one of the reasons on which they based their grounds for suspicion and filed the criminal complaint against Tadić.
„I want to remind the public that there are two servers, one for the BiH Court - CMS, which was the subject of today's SIPA activities, and the other for the BiH Prosecutor's Office, TCMS.
Justice and investigations cannot and must not be selective and selectively conducted. I remind the public that Ms. Tadić was removed from the position of Chief Prosecutor of the BiH Prosecutor's Office precisely because of the manual selection of 'suitable' prosecutors to whom she assigned cases, as a result of a disciplinary measure.

The public must know that Tadić's undisputed abuse, through the system of manual selection rather than automatically via the server, was confirmed by the Constitutional Court of BiH, which rejected Tadić's appeal and upheld the disciplinary decisions.
Precisely through manual selection, Tadić formed a suitable team of prosecutors to violate the right to a fair trial and raise an indictment against Mr. Fadil Novalić and others.
From all the above, the statement offered to the public by VSTV representatives is regrettable. It is regrettable that a message is being sent to the public 'catch the thief.' Why do I say this - because SIPA is acting on the order of the BiH Prosecutor's Office, an institution where the same things have been proven to happen and there are grounds for suspicion that they are still happening.
All this indicates that the rule of law and legal certainty are threatened and undermined.
As a member of Fadil Novalić's legal team, I call for an investigation to be conducted uniformly in accordance with the criminal complaint we filed, and for a search of the BiH Prosecutor's Office TCMS server as well, but I point out that, respecting the right to a trial before an impartial court, the investigation cannot be conducted by an institution and prosecutors for whom there are grounds for suspicion, and in the disciplinary proceedings it has been proven that the Prosecutor's Office, i.e., Tadić, did the same, even in a written note to us as a legal team, this was confirmed by Mr. Džermin Pašić, the prosecutor whom Tadić manually and personally appointed as prosecutor together with Hukeljić Mirza“, said Jahić.
