(VIDEO) RETROACTIVE PUBLIC Court of BiH published recording of the hearing for Milorad Dodik

(Patria) - After Milorad Dodik, suspected of the criminal offense of Attack on the Constitutional Order from Article 156, Paragraph 1 of the Criminal Code of BiH, 'voluntarily' appeared at the BiH Prosecutor's Office accompanied by his lawyer and gave a statement, the Court of Bosnia and Herzegovina decided to lift his detention and impose prohibitory measures.

As confirmed by the Court of BiH, the Prosecutor's Office sent a proposal to lift detention and impose prohibitory measures on July 4. Based on that proposal, a hearing was held before the duty judge at the Court of BiH, and after considering the proposal, detention was lifted. Dodik was subjected to prohibitory measures, including the obligation to report periodically to the competent state authorities.

In its statement, the Court of BiH reminded that in this phase of the procedure, only the Prosecutor's Office is authorized to conduct the investigation, and that the court's role involves ensuring the legality of actions by deciding on the Prosecutor's Office's proposals for certain measures, including measures to ensure the presence of suspects.

"On 04.07.2025, after the suspect Milorad Dodik, accompanied by his lawyer, voluntarily appeared at the BiH Prosecutor's Office, where he was questioned regarding the commission of the criminal offense of Attack on the Constitutional Order from Article 156, Paragraph 1 of the Criminal Code of Bosnia and Herzegovina (CC BiH), the BiH Prosecutor's Office submitted a proposal to the Court of BiH to lift detention and impose prohibitory measures, it was announced from the Court of BiH.

Based on the aforementioned proposal, a hearing was held at the Court of Bosnia and Herzegovina before the duty judge for the preliminary procedure, where it was considered, after which the Court made a decision to accept the proposal of the BiH Prosecutor's Office, and lifted detention and imposed prohibitory measures of mandatory periodic reporting to the state authority.

The Court of BiH notes that, in accordance with Article 35 of the Law on Criminal Procedure of Bosnia and Herzegovina, only the prosecutor is authorized to conduct the investigation and determine which actions will be taken, while the court's role, in this phase of the procedure, is to ensure the legality of the actions taken by deciding on the proposals of the BiH Prosecutor's Office for the implementation of certain measures that require a court decision, such as, among others, measures to ensure the presence of suspects",

Tatjana Kosović, the presiding judge during the hearing, stated that the hearing was public and being recorded. And, how public it was is evidenced by the fact that no one from the public knew about it until the joint statement of the Prosecutor's Office and the Court of BiH.
