Grand Chamber of the European Court overturns ruling in Kovačević case!

(Patria) - The Grand Chamber of the European Court of Human Rights in Strasbourg has delivered a final judgment in the case of Slaven Kovačević v. Bosnia and Herzegovina, reported Istraga on its X account.

The Grand Chamber concluded that there was no violation of the applicant's human rights. This decision overturned a previous ruling, in which the Court, in a smaller chamber, found that Kovačević's rights had been violated, specifically that his active right to vote was jeopardized.

Incidentally, this case subsequently turned into a significant political contest both inside and outside Bosnia and Herzegovina, in which all factors shaping the political reality of our country, including the Office of the High Representative, showed their true colors.

Before the Court ruled in Kovačević's favor in August, almost no one attached too much importance to this case. After becoming acquainted with the Court's conclusions stating that the constituent peoples in BiH are privileged and that citizens live in an "ethocracy," an offensive was launched by Zagreb, HDZ BiH, and the OHR, i.e., the US Embassy in Sarajevo, with the aim of dismantling the "Kovačević" case.

And it seems they succeeded.

The Grand Chamber, composed of 17 judges, made this decision after the state of Bosnia and Herzegovina requested a review of the earlier ruling. In the new final decision, the Court states that the constitutional framework of Bosnia and Herzegovina reflects the country's complex political and historical reality, and that the limitations in the electoral system are not a sufficient basis for concluding that the European Convention on Human Rights has been violated, specifically Article 1 of Protocol No. 12 (general prohibition of discrimination) and Article 3 of Protocol No. 1 (right to free elections).
