Constitutional Court Confirms: Law on Civil Service in FBiH Politicizes Public Service!

Today's ruling by the Constitutional Court of the Federation of BiH has once again confirmed that the Parliament of the Federation of BiH violated procedures when adopting one of the laws.

In this case, it violated the right to work of senior civil servants, adopted the law under an unjustified urgent procedure, delivered invitations for sessions of both houses of Parliament contrary to the prescribed deadlines, attempted to politicize public service, and set back public administration reform by 10 years, which was also confirmed in the European Commission's Report at the time.  

The Vice-President of the Federation of BiH, Milan Dunović, has repeatedly pointed out the politicization of public service, and it has been shown once again that his assessment and the Request for determining the constitutionality of the Law on Civil Service in FBiH from April were more than justified.

Following today's ruling by the Constitutional Court of FBiH, an opportunity arises for politicians in power to truly lead our country towards the European path, but without violating laws and the Constitution, without politicizing and without increasing the administrative apparatus.

- It is clear that everything done so far regarding public administration reform under the guise of the "reform agenda" has no constitutional basis. It is time for the ruling structures to truly address changes in the Federation of BiH and BiH as a whole, but taking into account the growing pleas of citizens, their problems, and the real situation in our country. Only in this way – by respecting the laws and the Constitution of their country, can they ensure a better path for it and its citizens. The path to the European Union – stated Dunović's cabinet.

Incidentally, the European Commission's 2016 Report also noted a setback regarding amendments to the entity legal framework for civil service in FBiH, which increase the risk of politicization.
