Constitutional Court of FBiH to rule today on appeals and developments in the House of Representatives of the FBiH Parliament

(Patria) - The Constitutional Court of the Federation of BiH will hold a session today to decide on four submissions by MPs in the House of Representatives of the FBiH Parliament concerning the constitutive session, but also sessions presided over by Mladen Bošković (HDZ) although he did not have valid authorization according to the Rules of Procedure of the House of Representatives, all while the resigned chairwoman Mirjana Marinković Lepić sat next to him.

The future of parliamentary life and democracy in the Federation entity will depend on the decisions of the Constitutional Court of FBiH, and any decision made outside the Constitution and other norms could lead this entity into a kind of political anarchy. This could lead to a loss of continuity in the functioning of government, because if the current parliamentary majority's attempt is not stopped, each subsequent one will have the right to act as it pleases.

If everything that the opposition MPs have appealed is allowed to pass without a reaction from the Constitutional Court of FBiH, then a message is sent that it is permissible to change the Rules of Procedure of the House of Representatives as one sees fit, and a phase of undemocratic and even unconstitutional functioning of the Parliament is entered.

SDA MP in the Parliament of the Federation of Bosnia and Herzegovina, Jasmina Bišćević-Tokić, on behalf of the opposition parties, requested a temporary measure from the Constitutional Court of the Federation of BiH regarding the decision on the appointment of Marin Vukoja to the Constitutional Court of BiH, i.e., in appeal U-7/24.

"As actively legitimized applicants for resolving the dispute between 40 MPs and the leadership of the House of Representatives of the Parliament of the Federation of BiH, and in order to prevent the occurrence of harmful consequences for constitutionality in the Federation of Bosnia and Herzegovina, we request the Constitutional Court of the FBiH to, in the case registered under number U-7/24, in accordance with the provisions of the Rules of Procedure of the Constitutional Court of the FBiH ('Official Gazette of the Federation of BiH' numbers: 4/10 and 18/16) issue a Decision on a temporary measure by which the House of Representatives of the FBiH Parliament is ordered to postpone the consideration of the election of a judge of the Constitutional Court of BiH elected by the House of Representatives of the Parliament of the Federation of BiH, until a final decision is made by the Constitutional Court of FBiH in case U-7/24", wrote Bišćević-Tokić on her Facebook profile.
