Constitutional Court of Bosnia and Herzegovina annuls results of referendum in Republika Srpska

The Constitutional Court of Bosnia and Herzegovina at today's session held in Sarajevo annulled the results of the referendum held on September 25, 2016, Patria reports.

The results were annulled because the referendum was conducted based on the Decision on calling a republic referendum of July 15, 2016, for which the Constitutional Court determined it was not in compliance with the Constitution of Bosnia and Herzegovina, and contrary to the order of the Constitutional Court from the Decision on interim measure number U 10/16 of September 17, 2016.

The Constitutional Court of Bosnia and Herzegovina adopted the request of Bakir Izetbegović, member of the Presidency of Bosnia and Herzegovina, and others "for resolving a constitutional-legal dispute with the entity Republika Srpska" in connection with the Decision on calling a republic referendum number 02/1-021-894/16 of July 15, 2016.

The Constitutional Court determined that the said decision on calling a republic referendum is not in compliance with Article I/2 and Article VI/5 of the Constitution of Bosnia and Herzegovina because that decision established a referendum question on which there already exists a final and binding decision of the Constitutional Court as an institution of Bosnia and Herzegovina, and such a decision must be respected by all public authorities and institutions.
