Constitutional Court of BiH rejects appeal of Nihad Bojadžić

SARAJevo, (Patria) - In response to the appeal of Nihad Bojadžić, convicted of war crimes in Trusina and Jablanica, the Constitutional Court of BiH stated that there was no violation of the right to a fair trial.

"The Constitutional Court concludes that there is no violation of the right to a fair trial under Article II/3.e) of the Constitution of Bosnia and Herzegovina and Article 6 of the European Convention when the contested judgments are reasoned and clear, when they were rendered by an impartial court, when the manner in which the factual situation was established and the evidence was assessed does not give an impression of arbitrariness, when they were rendered with the proper application of procedural norms, when nothing suggests a violation of the right to a fair procedure as a whole, and when the decision is not based on illegal evidence, nor was the appellant denied the right to defense," the Constitutional Court's decision states.

We remind that Bojadžić was sentenced to 15 years in prison by the Court of BiH.
