Constitutional Court of BiH today on RS Holidays Law

The Constitutional Court of BiH at today's plenary session will consider, among other things, the decision on non-execution of the decisions of the Constitutional Court of Bosnia and Herzegovina, U-3/13 Decision on the constitutionality of the Law on Holidays of Republika Srpska, writes the Patria News Agency.

This refers to an earlier decision of the Constitutional Court of BiH, which determined that Article 3b of the Law on Holidays of Republika Srpska is not in compliance with the Constitution of BiH.

In June, the six-month deadline expired within which the disputed article of the Law on Holidays of RS should have been amended. The Constitutional Court of BiH made the decision at the end of November 2015.

If the Constitutional Court of BiH concludes that the decision has not been executed, it will issue a special decision to that effect. This decision, like the previous one, will be forwarded to the competent Prosecutor's Office of BiH.

Article 3b states that "Republic holiday is Republic Day, January 9th", which the Constitutional Court of BiH ruled unconstitutional with its decision.

Ignoring the decision of the Constitutional Court of BiH, a referendum was organized in RS on September 25, where citizens voted on January 9 as Republic Day.

Last week, the procedure for amending the Law on Holidays of RS in accordance with the decisions of the Constitutional Court of BiH was initiated. It is not yet known when this issue will be considered at a session of the National Assembly of RS.
