CONSTITUTIONAL COMMISSION Opens Door for Vukoja’s Appointment, Opposition Announces Launch of Constitutionality Review

(Patria) - The Constitutional Commission of the House of Representatives of the Federal Parliament held a session today, concluding that "the procedure for electing a judge of the Constitutional Court of Bosnia and Herzegovina, elected by the House of Representatives, was carried out in accordance with the Constitution of Bosnia and Herzegovina, the Rules of Procedure of the House of Representatives, and the Decision on the procedure for electing judges of the Constitutional Court of Bosnia and Herzegovina, elected by the House of Representatives of the Parliament of the Federation of Bosnia and Herzegovina."

Opposing the adoption of this conclusion were members of the Constitutional Commission from the Democratic Front and the Party of Democratic Action, Mirza Čelik and Hakija Bošnjaković, who advocate that the procedure for electing a judge be conducted in a manner that establishes a proposal containing at least five names from the ranking list compiled by the Commission for Elections and Appointments and submits it to the House of Representatives for adoption, rather than, as the working group proposes, taking the highest-ranked candidate from the list and proposing only that person for judge of the Constitutional Court of Bosnia and Herzegovina. The opposition believes that a single candidate as a proposer for the election of a judge constitutes imposition, not election.

It was clarified that the aforementioned opinion of the Commission was adopted within the framework of considering the first item, which was an initiative by MP of Our Party Dragan Mioković to review the procedure for electing a judge of the Constitutional Court of Bosnia and Herzegovina.

The opposition announced the launch of a constitutionality review if Marin Vukoja is elected as a judge of the Constitutional Court of Bosnia and Herzegovina.
