UNSA wrote to the Municipal Court: We expect you to register the deans within two days!

SARAJevo, (Patria) - The University of Sarajevo today, through its attorney, filed three urgent requests with the Municipal Court in Sarajevo, Department for Registration of Legal Entities, for the registration of authorized representatives for the organizational units of UNSA, the Faculty of Medicine and the Faculty of Law.

The University of Sarajevo - Faculty of Law filed an application for the registration of an authorized person on October 5, and to this day, the Municipal Court has not made the change, and the name of the former dean is still in the court register.

The attorney for UNSA reminds the court that according to the provisions of Article 81 of the Law on Registration of Legal Entities, the court was obliged to make a decision on the application within five days.

“This is an omission by the presiding judge, or a significant violation of the Law on Registration of Business Entities, and according to Article 387 of the Law on Criminal Procedure of FBiH, due to the damage being done to the reputation of UNSA, which, due to the inaction of the presiding judge, is prevented from issuing valid diplomas to students upon completion of their studies, signed by an authorized person”, the urgent request states.

It is also noted that the appeals filed by the organizational units of UNSA regarding the registration of status changes are not a fact that constitutes a legal reason preventing the court from registering the change of authorized representatives of any organizational unit.

Regarding the Faculty of Medicine, an application for registration was filed on August 30 this year, but the data has not been changed to this day. A second application (in the meantime, the acting dean has changed) was filed on October 1, but no change has been made, nor has a decision been issued. 

“Therefore, we expect the court to make a decision or ruling on the application no later than two days from the receipt of this urgent request”, the urgent requests state.

Furthermore, on November 30, the Municipal Court in Sarajevo issued a decision rejecting the proposal for a temporary measure to suspend the financial and legal integration of UNSA in terms of labor relations. This measure was requested by the UNSA Trade Union, headed by Jasmin Velagić, who is also the dean of the Faculty of Electrical Engineering, one of the six faculties that filed appeals regarding legal integration, which have not yet been decided upon.

The Municipal Court used these appeals precisely to halt the registration of authorized representatives of the Faculty of Law and the Faculty of Medicine, even though there is no legal basis for such action, as these are two completely separate processes.

A decision has not yet been made regarding the formal promotion of graduates and master's students, which is scheduled to take place on December 18, but there is little time left for the Municipal Court to complete the registration in the court register and thus enable the signing of diplomas.
