Suspension of Judge Dalida Burzić Lifted, She Returns to Work at the Court of BiH Tomorrow

(Patria) - The Disciplinary Commission of the High Judicial and Prosecutorial Council (HJPC) of BiH has lifted the suspension of Judge of the Court of BiH Dalida Burzić, Istraga.ba learns.

The reason is that the Prosecutor's Office of BiH issued an order to suspend the investigation against Judge Burzić, who was suspected due to her actions in the "Dženan Memić" case.

Judge Burzić returns to work on Tuesday.

Dalida Burzić had been suspended since September 2022. At that time, the Prosecutor's Office of BiH issued an order to conduct an investigation against Burzić on suspicion that, as the chief prosecutor of the Prosecutor's Office of the Sarajevo Canton, she acted unlawfully during the investigation related to the death of Dženan Memić.

"The first-instance disciplinary commission considers that conducting a criminal investigation against the named person for the said criminal offense, while she performs the duties of a judge of the Court of BiH, jeopardizes the credibility of the said institution, which justifies her temporary removal from the position of judge of the Court of BiH until the conclusion of the criminal investigation initiated by the said order," the HJPC stated in September 2022.

From then until today, the Prosecutor's Office of BiH has not established any unlawfulness in the actions of Dalida Burzić and other suspects in this case, and therefore an order to suspend the investigation was issued.

We recall that in July 2021, the Prosecutor's Office of BiH filed an indictment against five individuals for organized crime and preventing the discovery and proof of the death of Dženan Memić.

The indictment was filed against Zijad Mutap, Alisa Ramić, Hasan Dupovac, Josip Barić, and Muamer Ožegović.

Dupovac is the former head of traffic investigations of the Ministry of Internal Affairs (MUP) of the Sarajevo Canton, and police officer Josip Barić has been in custody since earlier.

Alisa Ramić is the former girlfriend of the deceased Dženan Memić, who was with him at the time of the incident. She is also the daughter of the accused Zijad Mutap.

In the first-instance verdict of the Court of BiH, all accused were acquitted, but later the Appellate Chamber of the Court of BiH partially overturned the verdict.

In the second-instance proceedings, the Court of BiH issued a verdict by which Alisa Ramić (maiden name Mutap) was finally sentenced to two and a half years in prison, while police officer Hasan Dupovac was acquitted in the "Dženan Memić" case.

Almost five years after the Prosecutor's Office of BiH (prosecutors Ćazim Hasanspahić and Dubravko Čampara) launched an investigation into the "Dženan Memić" case, only Alisa Mutap was finally convicted under suspicious circumstances.

All others, from Dalida Burzić, through the police officers, to the father of Alisa Mutap, were finally acquitted or not even charged.
