UK Supreme Court to decide on parliament suspension this week

(Patria) – The UK Supreme Court will decide this week whether Boris Johnson acted unlawfully when he suspended parliament for 5 crucial weeks before the country's deadline to leave the EU.

However, the court faces two questions – whether the suspension is lawful, and whether the Supreme Court is the institution that should rule on it.

This question was raised during the court proceedings by Johnson's lawyer Sir James Eadie, who considers the suspension a matter of 'high policy' and therefore not subject to judicial review.

He also explained that, although parliament passed an act preventing a no-deal Brexit, it did not pass a vote of no confidence in the government, which would have halted the suspension of parliament.

One of the 11 senior British judges participating in the hearing, Lord Wilson, posed a rhetorical question asking whether there is anyone more appropriate to rule on the suspension of parliament than the UK Supreme Court.

The decision will be made public this week.
