
(Patria) – For months, the Ministry of Finance of the Federation of BiH has been ignoring inquiries from the Patria News Agency regarding unresolved cases of the Tax Administration, even though the Ministry is the second-instance body where appeals against decisions of the FBiH Tax Administration are filed. The ignoring continues, and the latest announcement from the Tax Administration once again raises the issue of losing millions of marks due to unresolved tax evasion cases that are becoming statute-barred.
In searching for information, we have come to learn that this problem is a kind of taboo topic, as it is not raised at sessions of the FBiH Government. It is simply skipped over, as if everything is in perfect order.
Enver Išerić warns of the "legitimate" collapse of the economic stability of the Federation. While pensioners fight for minimum pensions and veterans for symbolic allowances, the failure to resolve cases enables the acquisition of property gain at the expense of the Federation and its citizens.
According to available data, as of December 31, 2023, the number of unresolved appeals against decisions of the Tax Administration is 6,787, and the total debt that should have been collected is 635,597,740 KM. The problem arises because the Ministry of Finance does not resolve appeals within the legal deadline of 30 days, as prescribed by the Law on Administrative Procedure.
Today, the number of cases is even higher, and the Ministry, headed by Toni Kraljević (HDZ), ignores the appeals of experts.
The audit report of the Office for Audit of Institutions of FBiH for 2024 confirms the inefficiency of the Ministry, stating that at the end of 2023 there were 6,274 unresolved cases, while only 1,654 were resolved during the year. Such inaction can be considered a criminal act of abuse of position, given the millions in damages to the Federation.
Išerić emphasizes that the Tax Administration, the Ministry of Finance, and the Prosecutor's Office (POSKOK) should answer to the public questions about the total decisions, amounts of determined obligations, number of resolved and unresolved appeals, as well as cases of statute of limitations. This involves a loss of 635 million KM, which, as he says, requires an urgent response from all institutions of the Federation.
