Prosecutor's Office of BiH Transferred Case Against Dodik to East Sarajevo Because It Did Not See 'Incitement of Religious Hatred'

(Patria) - The Prosecutor's Office of BiH decided not to prosecute the complaint against Milorad Dodik for inciting religious hatred during a speech at a pre-election rally where he said that "Muslims are moving in like amoebas" into areas where Serbs live.

State prosecutors determined that the statements did not constitute the criminal offense of inciting national and religious hatred, so they transferred the case to the District Public Prosecutor's Office in East Sarajevo, with the suggestion that it be prosecuted as public incitement and encouragement of violence and hatred, confirmed for Detektor.

Milorad Dodik, following the activities of Siniša Karan, candidate for President of Republika Srpska, began his election campaign with statements that East Sarajevo must not allow Islamization.

- Forget those stories, we are the same people. We are not of the same faith. No one lies worse and more than a Turk. So all those candies they give us here, you can and should…

I don't have to tell you about it, you know perfectly well what it looks like. (…) What was done in East Ilidža? It was only made possible for Muslims to live there, right?

Do you think that is a blessing? Well, you know that better than I do. Where one moves in, it's like amoebas moving in - Dodik stated on November 10 in East Sarajevo.

The Prosecutor's Office of BiH first confirmed that it had formed a case, but soon announced that it had been transferred to the District Public Prosecutor's Office in East Sarajevo.

From the District Public Prosecutor's Office, it was confirmed to Detektor that they received an act from the State Prosecutor's Office on November 12 regarding the initiation of the case against Dodik, and a case was opened in East Sarajevo and assigned to the acting prosecutors.

After analysis, the Prosecutor's Office of BiH concluded that in Dodik's actions they do not see the elements of the criminal offense of "inciting national, racial and religious hatred, discord and intolerance" under the Criminal Code of BiH.

They believe that it could be a criminal offense of "public incitement and encouragement of violence and hatred" under the Criminal Code of Republika Srpska, stated the District Public Prosecutor's Office in East Sarajevo.

They told Detektor that they will take all necessary measures and actions with the aim of reaching a lawful prosecutorial decision, about which the public will be informed in a timely manner.
