Interpretation of 'Dayton': There is no giving and withdrawing consent to laws passed by the BiH PA

(Patria) - Milorad Dodik, SNSD president and BiH Presidency member, has been announcing for a long time, and yesterday he institutionally finalized it, and is embarking on a dangerous game of no return.

There have been numerous reactions following the adoption of conclusions in the RS National Assembly (NSRS) that open the way to undermining the constitutional order of BiH. Domestic and foreign officials are reacting and warning that this is undermining the constitutional order and a continuation of the escalation of relations.

Legal expert Enver Išerić states that this is undermining the constitutional order of BiH and that it sounds unbelievable that not a single state body has convened today.

"Has any state body - agency or institution - convened an extraordinary session after that, or has a session even been called?" asked Išerić.

Slaven Kovačević, a lawyer employed in the Cabinet of Željko Komšić, Chairman of the BiH Presidency, is of the opinion that there is no giving and withdrawing consent to laws passed by the Parliamentary Assembly of Bosnia and Herzegovina.

"However, if someone wants to play with that, then what is depicted in the image from Article 1, Paragraph 2 can happen. The Republic of Bosnia and Herzegovina was a subject of international law that signed an international agreement; neither entity was nor will be a subject of international law. So, go ahead and try with your distorted interpretations of Dayton, which you use to create crises and blockades," Kovačević wrote.

We remind you that in a joint statement by the embassies of the USA, France, Great Britain, Germany, Italy, and the EU Delegation regarding the events at today's special session of the National Assembly of Republika Srpska, it was clearly stated that the NSRS decision to begin drafting laws for the creation of parallel institutions in RS represents a further escalation step.

- Members of the ruling coalition in RS must be aware that the continuation of this dead end of challenging the Dayton Framework harms the economic prospects of the entity, jeopardizes the stability of the country and the entire region, and endangers the future of BiH in the EU. Increased tensions and the blocking of institutional functioning will limit economic opportunities available to citizens, deter investment, and distract from the fight against corruption. Politicians from RS and those in FBIH have the opportunity to continue dialogue and urgently find a solution.

We encourage all leaders to build mutual trust by immediately abandoning the rhetoric of division and escalation and returning to state institutions at full capacity, where they can discuss issues on which they disagree. The focus now should be on progress in reforms important for citizens and on the path to EU accession - the statement said.
