TI BiH files complaint against Gordana Tadić

Transparency International in Bosnia and Herzegovina (TI BiH) has submitted a request to the Disciplinary Prosecutor's Office to investigate the actions of the acting Chief Prosecutor of the BiH Prosecutor's Office, Gordana Tadić, citing several examples of the acting Chief Prosecutor's questionable actions and conduct, which are contrary to the provisions of the Law on the High Judicial and Prosecutorial Council, TI BiH announced, reports Patria News Agency.

- Namely, based on reports from the portal Žurnal, the acting Chief Prosecutor, Gordana Tadić, requested the Cantonal Prosecutor's Office of Sarajevo Canton to withdraw the case against Josip Šimić Đinđić, regarding whom the aforementioned prosecutor's office had opened an investigation for the criminal offense of "forgery of documents", although it is a criminal offense prescribed by the Criminal Code of the Federation of BiH.

TI BiH stated in the information submitted to the Disciplinary Prosecutor's Office that this indicates several possible disciplinary offenses, such as: interfering with the work of a judge or prosecutor with the intent to obstruct or undermine their activities; engaging in activities incompatible with the duties of a prosecutor; conduct in court or prosecutor's office and outside of court or prosecutor's office that harms the reputation of the prosecutorial duty, or any other conduct that constitutes a serious violation of official duty or calls into question public trust in the impartiality and credibility of the prosecutor's office.

TI BiH also highlighted Gordana Tadić's contradictory statements and announcements regarding the mentioned case, as well as the premature disclosure of unverified information about alleged surveillance and wiretapping and the authenticity of documents, which turned out not to be authentic (or at least their authenticity was not guaranteed at the time of disclosure).

The HJPC Law, as disciplinary offenses, explicitly lists: making any comments, until the case is resolved in court, which can reasonably be expected to interfere with or harm a fair procedure or trial, or failing to take appropriate steps to ensure that subordinate employees of the prosecutor's office also refrain from making comments.

Particularly concerning were the acting Chief Prosecutor's announcements at a press conference that the Minister of Security, Dragan Mektić, would be summoned for questioning due to previous statements, described as "in the capacity of a suspect", thereby calling for someone's prosecution solely based on their expressed opinion.

TI BiH has requested the Disciplinary Prosecutor's Office to act in accordance with its jurisdiction and investigate the submitted information, and to inform the public about its actions, considering that the mentioned statements and conduct of the acting Chief Prosecutor have attracted significant public attention, led to conflicts among law enforcement institutions, and further eroded the already low public trust in judicial institutions - TI BiH stated in its announcement.
