Court of BiH completely rejects indictment against Ahmet Sejdić and others

(Patria) - The Court of Bosnia and Herzegovina has completely rejected the indictment of the BiH Prosecutor's Office against Ferid Buljubašić, Ahmet Sejdić and others for a war crime that, according to the indictment, occurred in Jošanica near Foča in 1992.

As Faktor learns from sources close to this case, the defense and the accused will not receive written notification of this decision, as the procedure has not been completed.

Namely, the BiH Prosecutor's Office may file an appeal against the decision, and only after the final decision of the Court of BiH will the lawyers and suspects receive the official document.

The BiH Prosecutor's Office has the right to appeal this decision of the Court of BiH within 24 hours.

Let us recall, a team of prosecutors from the Special Department for War Crimes filed an indictment against 13 individuals, former commanders and members of the Army of the Republic of Bosnia and Herzegovina, who are charged with war crimes against victims of Serbian ethnicity in the village of Jošanica near Foča in December 1992.

According to the indictment, in this village, 56 civilians of Serbian ethnicity were killed, about 10 victims were wounded, and houses, property, agricultural and auxiliary buildings were set on fire and destroyed.

"The armed attack led and participated in by the accused was carried out on an undefended village, populated by civilian population, and among the victims were elderly people, women and children.

The oldest victim was an 88-year-old man and the youngest a two-year-old girl. Some of the victims were tortured and killed in an extremely cruel manner," the Prosecutor's Office stated in early August.

They added that the accused Ahmet Sejdić, as the brigade commander and a member of the TO staff, is additionally charged with crimes in the villages of Klisure, Bursići and Hadrovići in the Višegrad municipality, on August 8, 1992, which were outside the conflict and inhabited by civilian population of Serbian ethnicity, where during the attack eight civilians of Serbian ethnicity were killed, among them the oldest victim a 90-year-old woman, one civilian was wounded and three civilians were taken into illegal detention in the Višegrad area, and houses and buildings were set on fire and destroyed.

"The accused Ferid Buljubašić, as the commander and superior person, is additionally charged with war crimes against civilians of Serbian ethnicity in villages around Čajniče in February 1993, where during the attack in which ARBiH soldiers came via the territory of Montenegro, in the area of the villages of Šapići, Trpinje, Trojan and Ponikve, by firing automatic weapons, 11 civilians of Serbian ethnicity were killed, among whom were elderly men and women and one child, and five civilians were wounded, and houses and property were set on fire and destroyed," the indictment stated.
