Court of BiH: Detention is the only measure for unimpeded proceedings against Miletić, Šabić, and Brkić

The Criminal Panel of the Court of Bosnia and Herzegovina, deciding on appeals in the criminal case of Azra Miletić and others, rejected the appeals of suspects Azra Miletić, Senad Šabić, and Ramo Brkić, as well as the Prosecutor's Office of Bosnia and Herzegovina, as unfounded. The appeals were filed against the decision of the Court of BiH dated 28.02.2015, by which one-month detention was ordered for the suspects in this case, it was announced by the Court of BiH, reports the BiH news agency Patria.

After reviewing the arguments stated in the appeals, the responses to the appeals, and examining the contested decision within the scope of the appeal claims, the Panel, among other things, determined that the contested decision correctly assessed that there is sufficient evidence indicating a well-founded suspicion that Azra Miletić, Senad Šabić, and Ramo Brkić committed the criminal offenses for which they are suspected, and that it is well-reasoned why detention is the only measure by which the purpose, i.e., the unimpeded conduct of the criminal proceedings, can be achieved at this moment.

The Panel accepted the exhaustive reasoning for the special detention reason from point b), as well as the arguments based on which it was explained why the purpose cannot be achieved by other measures at this stage of the criminal proceedings.

Azra Miletić and others are suspected of the criminal offense of accepting a gift or other benefit from Article 217 of the Criminal Code of Bosnia and Herzegovina, the criminal offense of violating the law by a judge from Article 238 of the Criminal Code of BiH, and the criminal offense of giving a gift or other benefit from Article 218 of the Criminal Code of BiH.
