DAMAGES ARE INCREASING: Central Bank of Bosnia and Herzegovina's appeal against the Centar Municipality's decision accepted

(Patria) - The appeal of the Central Bank of Bosnia and Herzegovina (CBBH) against the Decision of the Centar Municipality, which rejected the request for urban planning consent, has been accepted as founded. The procedure has been returned to the Centar Municipality for reconsideration.

"Due to unjustified delays in the procedure, the amount of damage suffered by the CBBH is significantly increasing. There is an evident violation of legal deadlines for processing the CBBH's request, and unjustified and deliberate delays in the procedure within the jurisdiction of the Centar Municipality. The legal deadline of 15 days for issuing urban planning consent has long expired, and in the meantime, the prices of materials and services in the construction sector are significantly increasing, especially in the case of complex construction projects such as the business facility of the Main Unit of the CBBH. In this way, serious material damage is directly and continuously being inflicted upon the CBBH," stated the Central Bank of BiH.

The CBBH expects the Centar Municipality to act in accordance with the valid laws and planning documentation in force, and to comply with the Decision of the Ministry of Communal Economy, Infrastructure, Spatial Planning, Construction and Environmental Protection.

"We particularly emphasize that issuing urban planning consent is a legal obligation of the Municipality, i.e., the mayor. Despite the fact that the CBBH has shown goodwill regarding the acceptance of an alternative location for the construction of the business facility of the Main Unit of the CBBH, the Centar Municipality has not complied with the agreed-upon conditions. Confirmation of this is the letter from the Centar Municipality dated January 10, which shows that initiating the location exchange process would be an uncertain, insecure, and lengthy process for which the Centar Municipality provides no guarantee of outcome. The CBBH duly informed the Centar Municipality about this," the Central Bank of BiH points out.
