What the Autopsy of Dženan Memić Revealed: Why Has Doctor Hamza Žujo Not Yet Testified?

On Tuesday, February 7, 2017, at the Cantonal Court in Sarajevo, the trial of Ljubo and Bekrija Seferović will continue. They are charged with a serious criminal offense against the safety of public traffic, as well as the criminal offense of failing to provide assistance to a person injured in a traffic accident and the criminal offense of obstructing evidence, in the case of the death of Dženan Memić, reports the Patria agency.

The testimony of Muriz Memić, the father of the deceased Dženan, and six expert witnesses is scheduled. Interestingly, during the trial so far, witnesses (an emergency doctor, a neurosurgery resident at the University Clinical Center Sarajevo, traffic police officers, and members of the Ministry of Interior of the Sarajevo Canton) have spoken about the injuries sustained by the deceased young man, even though the most qualified person to speak on this is Dr. Hamza Žujo, a court expert in the medical field.

Dr. Žujo performed the autopsy of Dženan Memić's body on February 16, 2016, but to this day, the details of the injuries are not known.

Namely, in the indictment, Žujo was proposed as the first expert witness, and only after him were the expert witnesses proposed whom the Prosecutor's Office summoned for February 7, 2017.

Given that at the extraordinary session of the Cantonal Assembly, in the report of the Ad hoc body that conducted oversight of the work of the Ministry of Interior of the Sarajevo Canton and the Police Administration in the case „Dženan Memić“, details were revealed that police officers from the Ministry of Interior of the Sarajevo Canton, O.B. and D.H., were present at the autopsy of the deceased young man, but that there is no official record for D.H., who provided certain details about the injuries themselves, it is important to establish as soon as possible the actual injuries the young man sustained and the possibility of how they occurred.

However, the prosecutor in this case, Meris Ćato, nevertheless decided to bypass Žujo, even though he could provide numerous answers to the questions constantly raised by the Memić family and the public, which is disturbed by the concealment of the true truth about the death of this young man.

The lawyer for the Memić family, Ifet Feraget, requested from the Court that Muriz Memić be heard as a witness, given that he has direct knowledge of facts and evidence relevant to assessing whether the entire event could have occurred in the manner described in the indictment against the Seferovići.

- Given that this proceeding, due to all the already known circumstances, has caused the injured party and his family members to relive trauma, uncertainty, low mood, and sleep disorders, i.e., caused their secondary victimization, I ask the Court to, by its decision, appoint lawyer Ifet Feraget as an advisor for the injured party Muriz Memić during his hearing, based on Article 98, paragraph 4 of the Criminal Procedure Code of the Federation of Bosnia and Herzegovina, since it is evident that he is not able to exercise his rights during the hearing on his own, and his interests cannot be protected in any other way – states the submission.

Feraget also requested that the Court hear as a witness Nermin Šehović, the chairman of the Ad hoc body for conducting assembly oversight of the legality of the work of the Ministry of Interior and the Police Administration in the case „Dženan Memić“, regarding the legality of the evidence on which the subject indictment is based.

The Memić family, together with friends and citizens, will organize the fourth protest on February 8, the anniversary of the young man's death, and once again demand that the truth about the death of Dženan Memić be revealed.
