Softić and Džaferović Write to the Constitutional Court of BiH, Request Suspension of Referendum Decision

Chairman of the House of Peoples of the Parliamentary Assembly of Bosnia and Herzegovina Safet Softić and Deputy Chairman of the House of Representatives of the Parliamentary Assembly of BiH Šefik Džaferović today each individually submitted to the Constitutional Court of Bosnia and Herzegovina a request for resolving a dispute with the entity Republika Srpska, the National Assembly of RS, concerning the Decision on calling a referendum No. 02/1-021-894/16 of July 15, 2016 (Official Gazette of RS No. 68/16 of August 12, 2016), which is scheduled for September 25, 2016, reports the Patria agency.

In their requests, Softić and Džaferović, as applicants authorized by the Constitution of BiH, request that the Constitutional Court of BiH establish that the Decision on calling a referendum is contrary to Article I/2 and Article VI/5 of the Constitution of Bosnia and Herzegovina, and that it be annulled as such. It is also requested that the National Assembly of RS be obliged to undertake all activities to nullify all subsidiary decisions and activities based on the Decision on calling a referendum.

A request for the adoption of a provisional measure has also been submitted, seeking the immediate suspension of the implementation of the Decision on calling a referendum until the final decision of the Constitutional Court of Bosnia and Herzegovina, announced from the cabinets of Softić and Džaferović.
