Smajić: SDP and Trojka's claim that 'the Council of Ministers of BiH did not appeal the Kovačević ruling' is not true

(Patria) - Džemal Smajić, delegate (SBiH) in the House of Peoples of the Parliamentary Assembly of Bosnia and Herzegovina says that the claim by SDP and Trojka that 'the Council of Ministers of BiH did not appeal the Kovačević ruling and that it was not voted on because it was never an agenda item' is not true.

Smajić notes that in March this year, the Council of Ministers of BiH adopted a decision appointing Monika Mijić as acting agent.

“I remind Nikšić that the Council of Ministers, at its 56th session on July 18, 2024, contrary to the law, extended Monika Mijić's mandate by a conclusion instead of a decision, thereby enabling her to perform the function of agent of the Council of Ministers of BiH before the European Court of Human Rights in the Kovačević case. This illegality was pointed out by the Legislation Office, which was not even asked for an opinion regarding the mandates of acting agents,” says Smajić.

The entire process, he adds, is controversial because under the Law on Administration of BiH, an acting official can be appointed for a period no longer than three months, and in extraordinary circumstances, only a decision on appointing an acting head for an additional three-month term can be adopted. Through the collusion of Trojka, HDZ and SNSD, Mijić has been appointed as acting official for the seventh time.

“It is clear that this involves a series of illegalities, which raises the question of why the Prosecutor's Office of BiH has not yet become involved? What a scandal it will be for Bosnia and Herzegovina if agents without a mandate, who are performing their positions illegally, succeed in overturning the ruling before the highest legal institution of the Council of Europe!?

That shame will be on the faces of Trojka, which not only called into question the interests of the state but also uses deception to hide from the public the betrayal they have committed against the citizens of this country,” concluded Smajić.
