Salihović Case: Request for Švraka's Recusal Rejected

The President of the High Judicial and Prosecutorial Council of Bosnia and Herzegovina (HJPC BiH) Milan Tegeltija, deciding on the request for the recusal of the presiding judge of the First Instance Disciplinary Commission for Prosecutors Mahmut Švraka, submitted by the attorney of the defendant Goran Salihović in the disciplinary case against him, issued a Decision by which the request for the recusal of the presiding judge of the First Instance Disciplinary Commission for Prosecutors Mahmut Švraka is rejected as unfounded, Patria reports.

- Assessing the request for recusal, the President of the HJPC BiH concluded that the request did not point to any objective indicators of doubt regarding the impartiality of the presiding judge of the First Instance Disciplinary Commission for Prosecutors. Also, the applicant for recusal did not state justified circumstances and/or arguments that would call into question the impartiality of the presiding judge of the First Instance Disciplinary Commission for Prosecutors, for which reason the claims or allegations of bias of the presiding judge of the First Instance Disciplinary Commission for Prosecutors were assessed as sweeping and unsubstantiated - they state from the HJPC.
