The case everyone is silent about now: Why did judge Aida Hasić make an express decision regarding Lukač

Judge of the Municipal Court in Sarajevo Aida Hasić made a Decision on March 13, 2015, determining a temporary court security measure, which "orders the opposing party to immediately, upon receipt of the decision, make a decision on the appointment of Dragan Lukač to the position of Director of the FUP Police Administration, to which he was re-elected by the final and binding decision of the Independent Board of the Parliament of FBiH of January 19, 2015", writes the Patria News Agency.

Lukač filed a lawsuit against the FBiH Government with the Municipal Court in Sarajevo because they "prevented him from being the Director of the Federal Police Administration".

He requested from the Municipal Court to issue a security measure, i.e., to keep him at the head of the FUP until the dispute is resolved!

The FBiH Government sent a response to this lawsuit on Monday, March 16, proposing that the court dismiss the Proposal for determining a temporary security measure, or reject it as unfounded.

Incidentally, the Government received the lawsuit and the proposal for determining a (temporary) security measure on March 9, 2015, because the FBiH Legal Affairs Office declared itself incompetent to represent in this matter on February 23, 2015.

We remind you that the FBiH Government made a unanimous Decision on February 10, 2015, not to accept the final proposal of the Independent Board for the appointment of Dragan Lukač as Director of the Federal Police Administration.

The Government made this decision because the legal prerequisites for considering the Decision on the final proposal of the Independent Board of the Federation of Bosnia and Herzegovina were not met.

The saga surrounding Lukač's election began in October 2014, and the Independent Board, led by Sead Selman, wanted to appoint Lukač as FUP Director at all costs, even though the new Law on Internal Affairs of FBiH had come into effect.

The Office of the Government of the Federation of Bosnia and Herzegovina for Legislation and Alignment with European Union Regulations confirmed that the tender procedure for the election of the Director of the Federal Police Administration was carried out contrary to the law, i.e., that it was necessary to announce a tender under the new law on internal affairs.

However, this did not prevent the Independent Board of PFBiH, led by Selman, from proposing Dragan Lukač twice for the election of the Director of the Federal Police Administration, even though he was obliged several years ago to initiate proceedings for his dismissal due to proven criminal activity and serious breaches of official duty.

The Legal Affairs Office declared itself incompetent, the FBiH Office for Legislation confirmed that Lukač's election was carried out outside the legal procedure.

None of this prevented the new Minister of Internal Affairs of FBiH, Aljoša Čampara, from finding a suitable person in the Municipal Court in Sarajevo to issue a decision that would return Lukač to the position of FUP Director, as Patria has learned.

Judge Aida Hasić made this decision in an express manner, while in cases like Dragan Vikić, Himzo Selimović, Momčilo Tubić, whom Lukač unlawfully and arbitrarily dismissed from their jobs, court decisions have been pending for years.

It is also indicative that for Judge Hasić, even the opinion of the FBiH Office for Legislation, which is managed by the extremely experienced legal expert Željko Silađi, was not relevant, nor did she take it into consideration.
