Memic Case: Reconstruction Features Three Conflicting Accounts of Dzenan and Alisa's Movement

SARAJEVO, (Patria) - During today's continuation of the trial of Ljubo and Bekrija Seferovic in the Dzenan Memic case, a reconstruction from June 14, 2016, from Velika aleja was presented, concerning the events of February 8, 2016, when Memic died under still unexplained circumstances. 

Four prosecutors from the Sarajevo Cantonal Prosecutor's Office attended the reconstruction. Suspects (at the time, editor's note) Vasvija Sejdovic and Ljubo Seferovic, as well as the injured party Alisa Mutap, were most extensively questioned by prosecutor Sead Kreshtalica. Experts in traffic and medical fields, as well as ballistics, were also present at the reconstruction.

During the playback of the video, the presiding judge of the Trial Chamber, Igor Todorovic, reacted by saying: "This is not a reconstruction, but a witness statement.".

Lawyer Rusmir Karkin said: "Object to the prosecutor, not to me.".

Kreshtalica asked Sejdovic to show the spot where Ljubo allegedly hit Dzenan Memic, and after she showed the spot, the prosecutor indicated another location. Prosecutor Ivana Petkovic, who transferred to the BiH Prosecutor's Office in August 2016, also attempted the same.

Sejdovic stated that Ljubo was drunk that night, and that their six children were also in the van. Sejdovic said there was no "girl" on the road and that she did not see her on the ground.

She showed what was broken or damaged on the van after the impact. She also stated that Ljubo did not stop but continued at high speed, and that she told him he had hit someone. She confirmed that she did not see how far the young man's body was thrown. During the reconstruction, she positioned the mannequins representing Dzenan and Alisa with a gap of almost two meters between them. Sejdovic also stated that the young man was hit on the left side of the avenue.

She also said that Ljubo was repairing the van with a hammer, and that on the same day, he had hit a company fence with the rear of the van.

Karkin repeatedly asked for the video to be stopped, and stated that Sejdovic was not showing the location where the Prosecutor's Office claimed the impact occurred.

She claims that "no one hit the girl.".

When asked by the prosecutors what Dzenan was wearing that night, Sejdovic said white jeans and a white t-shirt. As a reminder, Dzenan's clothing was previously shown at the trial. He was wearing blue jeans, a dark sweater, and a blue jacket.

During the reconstruction, Kreshtalica asked Ljubo Seferovic to show the damage to the van and describe how and where he repaired it. Ljubo said he only felt an impact and thought he had hit a tree.

- My wife told me I hit a pedestrian. I'm not sure what I hit - Ljubo said.

He admitted that he was under the influence of alcohol and that there were children in the van.

He stated that it was 10:30 PM when he was driving down Velika aleja, at a speed of 40 to 50 km/h. He said he looked in the rearview mirror and saw someone lying on the left side. He stated that the windshield, door frame, and turn signal were damaged, and that he only repaired the damage by "filling" it. He confirmed that he did not straighten anything, although Vasvija said he used a hammer.

Ljubo also confirmed that both lights were working, meaning the bulbs were intact after the alleged impact. 

During the reconstruction, prosecutor Kreshtalica can also be heard telling prosecutor Meris Cato (who left the Sarajevo Cantonal Prosecutor's Office in April 2018) that Ljubo does not know the exact point of contact.

When the part of the video featuring Alisa Mutap began, lawyer Karkin reacted, stating that prosecutor Kreshtalica had confirmed that there was also a first reconstruction of the event. Prosecutor Mladen Furtula said that a reconstruction was carried out, but there was no video recording or report.

During the reconstruction, Mutap confirmed that she and Dzenan were walking side-by-side on the right side.

- We were touching shoulders, it was quiet, the lights were on - Mutap said.

She said she later remembered "the policeman who said everything would be alright.".

She also rejected the possibility that they were walking in the middle of the road, given that the container served as her orientation. She even positioned the mannequins on the right side of the road, with herself walking along the very edge of the right side of the asphalt.

This makes it even stranger how it is possible that the traffic expert Seval Kovacevic stated in his report that the injured parties were walking "in the middle of the road with a gap between them," even though he himself heard Alisa Mutap's statement during the reconstruction.

Lawyer Feraget: This is not a reconstruction, but a fabrication

After the hearing, the father of the murdered young man, Muriz Memic, did not hide his outrage.

- Now we know who the leader of the criminal organization is, and that is Dalida Burzic, the Chief Prosecutor of the Sarajevo Cantonal Prosecutor's Office, and her accomplices are Sead Kreshtalica, Furtula, Amina Rizdic, Cato, who is now former... Kreshtalica points to a spot for them to show, but Vasvija and Ljubo won't.

Memic also claims that the reason for the video being paused, with several minutes missing, is to prompt the suspects to give testimony that suits the Sarajevo Cantonal Prosecutor's Office.

- There was no traffic accident. The criminal gang exists, it is the Cantonal Prosecutor's Office, and I will not stop. I can only tell them that I will endure. In this entire reconstruction, only Alisa told the truth. She knows where they were moving, she knows who jumped out from behind a tree and hit Dzenan. Alisa knows, she is an accomplice. She said everything at the first reconstruction. It was done for murder, and that's why they hid her. This is the 21st century, can you believe there are no recordings, no one took photos. The main evidence is hidden - Memic said.

Memic noted that he had filed a criminal complaint against Kreshtalica and did not understand why he was still conducting the proceedings. He also stated that this case is the end for Dalida Burzic in the BiH judiciary.

Lawyer Feraget noted that the reconstruction was carried out on June 14, and that the murder investigation lasted until June 24, 2016.

- How is it possible to then conduct a reconstruction for a traffic accident? - Feraget asks. 

Three hearings in July 

Lawyer Karkin said that he wants to read parts of the report of the Ad hoc commission in the Dzenan Memic case, but that he is unable to do so today due to fatigue and fasting. He also stated that he will submit a list of material evidence he wishes to introduce to the Court. The Court has scheduled three hearings in July: on the 2nd, 4th, and 12th of July.
