Memic Case: Court Approves Three New Expert Examinations, But Not Alisa Mutap's Testimony

A continuation of the trial of Ljubo Seferović and his father Bekrija was held at the Cantonal Court in Sarajevo for the criminal offense of a serious offense against public traffic safety and for the criminal offense of failing to provide assistance to a person injured in a traffic accident and the criminal offense of obstructing evidence, in the case of Dženan Memić, reports the Patria agency.

The court panel, presided over by judge Igor Todorović, made a decision to accept the defense's proposed evidence related to the criminal offenses for which the accused are being tried. Judge Todorović stated that he does not want this trial to turn into an investigative procedure for some other criminal offense.

The court approved three new expert examinations: one by a medical expert (from the Institute of Forensic Medicine of Republika Srpska), one by a traffic expert to be performed by Arnes Hadžiosmanović, and one by a mechanical expert, Adnan Hasanović.

The lawyer for the Memić family, Ifet Feraget, said that these three expert examinations should provide answers to all disputed questions.

- It is necessary here to establish facts that concern only the criminal offense attributed to the accused. The court does not have the authority to establish facts that are outside the factual description of the criminal offense for which the trial is being held – Feraget said.

The court approved the testimony of seven witnesses. Vasvija Sejdović waived her privilege not to testify and will be heard on matters known to her regarding the events related to February 8, 2016, when Dženan Memić was injured. Brothers Admir and Asmir Gadžo, who previously stated they saw a dark-colored van, will also give their testimony again.

Police officers from the Ministry of Internal Affairs of Canton Sarajevo, Nermin Halilović, assistant commander of the Ilidža Police Station, Elvedin Boja and Velibor Ristivojević, officers of the Ilidža Police Station, who arrived at the scene immediately after the members of the Directorate for Coordination of Police Bodies of Bosnia and Herzegovina and who were the first to speak with the only witness that night, Alisa Mutap, will also appear as witnesses. Interestingly, the Court did not approve her testimony.

Sefedin Škrijelj, a traffic investigator, will also testify regarding the conducted investigation, as will Senad Mešić.

An inspection and reading of the material evidence proposed by the defense will be carried out. Although the defense also requested a new reconstruction, the Court has not yet approved it, but the possibility remains that it will still be carried out.

- The reconstruction was rejected because the Court believes that the expert examinations will provide answers to all disputed questions. The specificity of this reconstruction is that the injured party would also attend, which was not the case before. The Court's decision is correct and expected – Feraget said.

The trial will continue on September 14, when witnesses Asmir and Admir Gadžo will appear, who will be questioned by defense attorney Rusmir Karkin.

Otherwise, the Memić family will organize another peaceful protest to finally reveal the truth about the death of Dženan Memić. Dženan's father, Muriz Memić, thanked the media for following this case, but also clearly stated that the media are facing various pressures due to this case.
