SDA satisfied with new processes in forming post-election coalitions

SARAJEVO, (Patria) - Several conclusions were reached at the SDA Presidency session, and SDA believes that decisive and concrete measures must be taken to improve the position of Bosniaks and Croats in the RS entity, in accordance with the constitutional provision on the constituent status of all peoples in every part of Bosnia and Herzegovina.

- Discrimination and obvious apartheid, achieved through the persistent decade-long actions of the RS authorities and the passivity of the OHR and the international community, have turned the RS entity into a black hole on the map of human rights in Europe in the 21st century. Among other things, Bosniaks are not allowed to use their constitutionally guaranteed right to the name of their own language, the authorities of the RS entity award decorations to convicted war criminals, refuse to implement the decisions of the Constitutional Court of BiH, and discrimination in the employment of Bosniaks and Croats in RS public enterprises is evident.

The name "Republika Srpska" has been used as a tool and justification for discrimination. If the attitude of the authorities in the RS entity towards the constitutionally guaranteed rights of Bosniaks and Croats does not change, authorized proposers from SDA will file an appeal with the Constitutional Court of BiH, or proceedings will be initiated before the European Court of Human Rights in Strasbourg, in order to include the names of the other two constituent peoples in BiH in the name "Republika Srpska" - say from SDA.

The reaction of the Office of the High Representative (OHR) and the Peace Implementation Council (PIC) to the announcement that SDA will file an appeal seeking to eliminate discrimination in the RS entity is a paradigm of the complete attitude of the international community towards anti-Dayton and unconstitutional actions, claim SDA, adding that this attitude of the PIC, which has lasted for a decade, in which responsibility is artificially distributed according to an unfair matrix of 'three sides', has enabled the preservation of systematic discrimination against Bosniaks and Croats in the BiH entity RS.

- Experience shows that "strong condemnations" and "expressions of concern" are not enough and that they only encourage destructive forces that attack the constitutional order and endanger peace in Bosnia and Herzegovina. SDA believes that the OHR and PIC must take action and finally fulfill the obligations from the mandate entrusted to them, prevent discrimination, stop attacks on Bosnia and Herzegovina, and the increasingly obvious endangerment of peace - emphasize from SDA.

SDA also welcomes the normalization of negotiation processes on defining post-election coalitions. Negotiation processes need to be accelerated so that we can form governments at all levels as soon as possible. Governments should be led by parties that won the elections and that represent the predominant will of the voters.

Following the Decision of the Constitutional Court declaring itself incompetent regarding the appeal of the SDA Deputies' Club concerning the CEC's Instruction, SDA will continue to participate in the election of delegates to the House of Peoples of the FBiH Parliament in accordance with the contested instruction, which is temporary in nature. However, when adopting amendments to the Election Law regarding the election of delegates, SDA will insist exclusively on amendments that are in accordance with the provisions of the Constitution of FBiH.

The party says that with the appointment of Gordana Tadić to the position of Chief Prosecutor of the BiH Prosecutor's Office, the process of unconstitutional removal of Bosniaks from leading positions in the judiciary has been completed.

- During the time when Gordana Tadić held the position of acting Chief Prosecutor, the process of sanctioning those responsible for the unconstitutional referendum on marking January 9 as the Day of RS was halted, and the process of mass arrests and prosecution of commanders of the Army of RBiH began in order to create an artificial ethnic balance in the prosecution of war crimes. These were obviously the main references and merits for the appointment of Gordana Tadić to this position. It is more than clear that the majority of members of the High Judicial and Prosecutorial Council are mere implementers of policies that, for the aforementioned reasons, want to remove Bosniaks from the top of the judiciary and prevent the BiH Prosecutor's Office from decisively tackling corruption.

SDA will seek a thorough reform of the BiH judicial system, as well as the transformation of the HJPC and its competencies, in order to restore citizens' trust in the entire judicial system - it is stated.
