Poslovnost Agency Workers in front of the Municipal Court: We demand the right to work

SARAJevo, (Patria) - Workers of the Poslovnost Agency, who have been prevented from entering their workplaces for days and have already been forced to use a window entrance, gathered today for a peaceful protest in front of the Municipal Court in Sarajevo. Although the Municipal Court issued a temporary measure ordering the removal of security guards hired by the company Brend d.o.o., it has not yet been implemented. The workers expressed their protest with whistles and banners due to the court's sluggishness in ensuring the execution of the court measure. 

"A temporary court measure is the most urgent measure in civil litigation, and its execution should be completed within 48 hours. Given that the measure issued on 08.09.2020 has not yet been implemented, the court is in danger of making the entire judicial system a mockery. The Municipal Court is yet another institution that, through its (in)action, jeopardizes the existence of 80 people and their families," stated the Poslovnost Agency. 

As part of the public is already aware, Brend d.o.o. and Poslovnost Agency have been involved in a property dispute for the past few years. The dispute concerns approximately 50m2 of the building to which both companies lay claim. In order to pressure the Poslovnost Agency to abandon the protection of its rights in court, the Brend company decided to prevent access to the building for the Poslovnost Agency workers through acts of self-will. Interestingly, all competent institutions have declared themselves incompetent in this case, referring the matter to the Municipal Court. When the Court finally issued a measure stating that the elements of such violence are unacceptable, a way was found not to execute the measure, by delaying the delivery of the decision to the Brend d.o.o. company. Since it is a fictitious company, the delivery of the decision could take years. The delivery process can be completed within two hours by posting the decision on the notice board of the Municipal Court.

The company Brend d.o.o., apart from the authorized representative – Fuad Džafić, Mediha Džafić – founder and director Naser Šukurica, has no employees. The founder of the Brend company, Fuad Džafić, is mentioned in several court proceedings in which he was linked to convicted criminals serving multi-year prison sentences. The Poslovnost Agency, on the other hand, employs about 80 workers and has over 800 clients. The unwillingness of all institutions (municipal urban planning and construction inspection, Ministry of Internal Affairs, KS Prosecutor's Office, and Municipal Court) to act within their jurisdiction has called into question the existence of 80 workers who have been contributing to the budget for years.
