PSBiH: Call on the Prosecutor's Office to investigate the purchase of the building for the ITA, and Krišto to submit a proposal for the Minister of Security to the procedure

(Patria) - Immediately after the 26th, the House of Representatives of the Parliamentary Assembly (PA) of Bosnia and Herzegovina held the 27th emergency session in Sarajevo today, with four items on the agenda.

After a discussion on the agenda item titled "Illegal conduct of the Chairwoman of the Council of Ministers of Bosnia and Herzegovina, Borjana Krišto, by failing to act in accordance with Articles 10 and 14 of the Law on the Council of Ministers of Bosnia and Herzegovina and by failing to implement the conclusions of the 28th session of the House of Representatives of the PA BiH," the House of Representatives adopted a conclusion requesting Krišto to act within seven days in accordance with the conclusions of the 28th session ("Official Gazette of BiH," nos. 32/02 and 72/17).

At its 28th session, the House of Representatives adopted a conclusion instructing Chairwoman Krišto to, in accordance with Articles 10 and 14 of the Law on the Council of Ministers of Bosnia and Herzegovina, appoint and submit for verification procedure the proposal for the Minister of Security of Bosnia and Herzegovina, which was submitted to her on March 18 by the chairs of five clubs in the House of Representatives of the PA BiH.

Regarding the agenda item titled "Illegal conduct of the Indirect Taxation Authority (ITA) of Bosnia and Herzegovina in the procedure of purchasing an existing building in the area of Banja Luka for the purpose of accommodating employees and accompanying equipment of the ITA BiH for the Main Office and the seat of the Banja Luka Regional Center," the House of Representatives adopted a conclusion which reads:

"The House of Representatives of the PA BiH calls on the Prosecutor's Office of Bosnia and Herzegovina to establish criminal responsibility for the non-execution of the conclusions of the House of Representatives when adopting the Report on the conduct of public hearings of representatives of the Audit Office, the Director of the ITA BiH, the President of the Independent Union of Civil Servants and Employees of the ITA BiH, and the first President of the Independent Union of Civil Servants and Employees of the ITA BiH, in connection with the planning, approval, and implementation of the multi-year project for the procurement and construction of a building for the Banja Luka Regional Center and for the Main Office of the ITA BiH in Banja Luka."

In connection with this agenda item, the House of Representatives also adopted the following conclusions:

1. The House of Representatives of the PA BiH, in accordance with Article 2, paragraph 2) of the Law on Administrative Disputes of Bosnia and Herzegovina ("Official Gazette of BiH," nos. 19/2002, 88/2007, 83/2008, and 74/2010), instructs the Attorney's Office of Bosnia and Herzegovina to, in accordance with its competencies, file legal remedies and undertake legal actions to initiate an administrative dispute by filing a lawsuit before the Administrative Division of the Court of Bosnia and Herzegovina to challenge the Decision on the selection of the most favorable bidder in the open procedure for collecting offers for the purchase of an existing building in the area of the city of Banja Luka for the purpose of accommodating employees and accompanying equipment of the Indirect Taxation Authority for the Main Office and the seat of the Banja Luka Regional Center, number: 01-16-12-936-51/25 of July 24, 2025.

Through the lawsuit for initiating an administrative dispute, the Attorney's Office of Bosnia and Herzegovina will challenge the aforementioned Decision in order to establish that it is contrary to the stated provisions of the Law, and will request that it be annulled in accordance with Article 12, paragraph 1) of the Law on Administrative Disputes.

2. The House of Representatives of the PA BiH instructs the Attorney's Office of Bosnia and Herzegovina to, in accordance with Article 18 of the Law on Administrative Disputes, submit a request to the Indirect Taxation Authority of Bosnia and Herzegovina to postpone the execution of the contested Decision until the final court decision, because the execution of the contested Decision would cause damage to Bosnia and Herzegovina that could not be repaired.

If the Indirect Taxation Authority of Bosnia and Herzegovina does not postpone the execution of the contested Decision, the Attorney's Office of Bosnia and Herzegovina is instructed to, in accordance with the aforementioned Article 18 of the Law on Administrative Disputes, request in writing from the Court the postponement of the execution of the contested Decision against which the lawsuit has been filed.

After a discussion on the agenda item titled "Establishing lawful leadership in the State Investigation and Protection Agency (SIPA), which has been undermined and usurped by the arbitrary resignation, abandonment of duties, and attempt at unlawful reinstatement of Darko Ćulum to the position of director," a proposal for conclusions submitted by MP Jasmin Emrić was forwarded to the Collegium of the House for harmonization, due to the lack of an entity majority. The proposal reads:

1. The House of Representatives of the PA BiH requests from the responsible officials and competent services in SIPA to, in accordance with Article 119, point 1 of the Law on Police Officers ("Official Gazette of BiH," nos. 27/04, 63/04, 5/06, 58/06, 15/08, 63/08, 35/09, and 07/12), which clearly stipulates that a police officer's employment terminates and he automatically loses the status of a police officer in the event that he voluntarily submits a resignation, urgently issue a decision on the termination of employment for Darko Ćulum, effective March 18, 2025, because on that day he voluntarily resigned.

2. The House of Representatives of the PA BiH requests from the Council of Ministers of Bosnia and Herzegovina to urgently, in accordance with Article 55a, paragraphs 2 and 4 of the Law on Administration ("Official Gazette of BiH," nos. 32/02 and 72/17), appoint an acting director of SIPA.

A proposal for a conclusion submitted by MP Nihad Omerović was also forwarded to the Collegium of the House for harmonization, due to the lack of an entity majority. It reads:

"The House of Representatives of the PA BiH calls on the Prosecutor's Office of Bosnia and Herzegovina to carry out legally prescribed actions within its competence, related to the conduct of the former director of SIPA, as well as responsible persons within the Council of Ministers of Bosnia and Herzegovina for actions related to the non-appointment of the director of SIPA after Darko Ćulum voluntarily left the position of director of SIPA."

The House of Representatives of the PA BiH gave its consent for the ratification of the Loan Agreement (GrCF2 W2 F2 – Energy Efficiency of Public Buildings in Tuzla Canton) between Bosnia and Herzegovina and the European Bank for Reconstruction and Development.
