(Patria) - The Council of the Cantonal Court in Sarajevo, presided over by judge Jasenko Ružić, issued a verdict sentencing Ammar Muzur (26) to four years in prison for the murder of Armin Kahvić (33) in October last year on the slopes of Igman above the settlement of Hrasnica.
As stated, it was a murder committed in excess of self-defense.
The time spent in custody has been included in his sentence, and he is exempt from court costs.
Also, the Court has revoked his custody, and Muzur will be released.
Muzur was accused of inflicting multiple stab wounds to the chest on Kahvić with a knife, after an argument and fight, which resulted in his death. The Cantonal Prosecutor, in her closing statement, requested that the accused be found guilty of murder and punished according to the law. She emphasized that from the evidence presented, "it is clear that the accused committed the criminal offense of murder with which he is charged beyond a reasonable doubt," writes Faktor.
"All the evidence presented indicates that the event in question occurred as stated in the indictment," said the prosecutor, referring to the statements of witnesses and the accused himself.
On the other hand, the defense attorney for the accused, lawyer Omar Mehmedbašić, asked the Court to impose the mildest possible sentence on his client. Among other things, he stated that the deceased had been looking for his client, who had been avoiding him, that he found him on the way to Igman and attacked him first.
"This happened in fear for his life. This is not a case of murder, perhaps not even exceeding self-defense, but of pure defense. Because on one side there was a stone, and on the other side a knife, and a fatal consequence occurred," said Mehmedbašić, among other things.
The verdict is not final and an appeal to the Supreme Court of FBiH is permitted.
