Criminal complaint filed against Mayor Komšić!

A former employee of the City Administration of Sarajevo filed a criminal complaint against the current mayor Ivo Komšić, and the complaint was filed with the Cantonal Prosecutor's Office in Sarajevo, the BH News Agency Patria has learned from this judicial institution.

As stated in the criminal complaint, Komšić, acting contrary to the Law on Civil Service of FBiH and contrary to the Rulebook on uniform criteria, rules and procedures for appointing and assigning civil servants, with the intention of causing harm to another, abused his official position, thereby committing the criminal offense of abuse of official position.

Namely, shortly after his appointment, Komšić changed the Rulebook on internal organization and systematization, while a court proceeding is underway regarding the same, thereby committing a criminal offense and at the same time violating the Statute of the City of Sarajevo.

Komšić abused his position and authority because, by amending the Rulebook on internal organization and systematization, he directly violated the Statute of the City of Sarajevo.

The Statute of the City of Sarajevo clearly and decisively states that amendments and additions to the internal organization are made with the consent of the City Council.

- It is important to note that precisely according to the illegally amended Rulebook on internal organization and systematization, the competition for the secretary of the City Administration of Sarajevo was announced, while the legally conducted competition remains in the mayor's drawer, all according to SDA instructions - says our source.

The amendment to the rulebook enabled the candidacy of Elvir Hadžiahmetović for the secretary of the City Administration - City of Sarajevo, an SDA cadre, who until then held the position of Head of the Mayor's Cabinet, and is a political scientist by profession.

Hadžiahmetović was elected secretary of the City Administration of Sarajevo because, according to the amended illegal rulebook on internal organization, the secretary can be any university graduate, not just a lawyer. The City of Sarajevo, headed by Mayor Ivo Komšić, is a unique institution where the secretary of the institution does not have to be a lawyer.

Mayor Ivo Komšić is damaging the budget of the City of Sarajevo because, knowingly, since the beginning of 2013, he has illegally postponed the employment of persons based on a legally conducted competition.

Even after the decision of the Administrative Inspection no. 03-05-11909/13 of 20.03.2014, which orders the mayor to employ workers based on a legally conducted competition and terminate all service contracts, the Mayor of Sarajevo Ivo Komšić continues to break the law, signing new service contracts and postponing the employment of workers based on a legally conducted competition.

BUDGET OF THE CITY OF SARAJEVO DAMAGED

Even after the initiation of legal proceedings, the mayor continues to break the law and not implement laws, and thus continues to damage the budget of the City of Sarajevo in the form of increased obligations that will be determined by the court, plus the corresponding default interest which grows every day.

- Until the publication of this text, not even a periodic report has been submitted to the Ministry of Finance of Sarajevo Canton, which is a legal obligation of budget users. According to the Law on Budgets of FBiH, a fine in the amount of KM 1,000 to KM 5,000 is foreseen for the responsible person of the budget user - added our source.
