Complaint against Kajganić submitted to the Disciplinary Prosecutor's Office, witnesses of crimes and camps in Sanski Most demand the dismissal of the Chief Prosecutor

(Patria) - Following information that Chief State Prosecutor Milanko Kajganić banned the submission of an indictment for crimes in Sanski Most and Manjača to the Court of Bosnia and Herzegovina for confirmation, a complaint against him has been submitted to the Disciplinary Prosecutor's Office, and victim associations are announcing protests.

The High Judicial and Prosecutorial Council (HJPC) confirmed to Detektor that they received material in the evaluation process which will be considered at a meeting of the HJPC's Standing Commission for the Efficiency and Quality of Prosecutor's Offices, scheduled for February 5.

"In the meantime, a complaint of the same content has arrived and has been protocolled in accordance with the procedure and submitted to the Disciplinary Prosecutor's Office for processing," the HJPC briefly responded.

Detektor published on Friday that Izet Odobašić, a prosecutor at the State Prosecutor's Office, sent information to the HJPC's Standing Commission for the Efficiency and Quality of Prosecutor's Offices regarding the actions of Kajganić, who banned the submission of an indictment for crimes in Sanski Most and Manjača to the State Court for confirmation, filed against, allegedly, his former high school teacher and police academy professor, and other individuals. According to the information, which journalists had access to, one case in the BiH Prosecutor's Office's statistical annual report from last year is not listed as completed, even though an indictment has been filed.

According to the information, Kajganić did everything to prevent the indictment against suspect Mile Došenović, who, in the commission of criminal offenses in the case, served as the head of the Department for Combating and Detecting Crime and an executor in the Sanski Most Public Security Station.

Nihad Ključanin from Sanski Most, who spent 496 days in camps and prisons, says he cannot believe that after so many years, prosecutors are protecting some of those responsible for the crimes committed in this city by obstructing indictments.

"Let's not forget that 785 people were killed in Sanski Most, of whom 47 were children. This was mainly done by the army and police. I was arrested by the police and taken to Manjača. I know the names of the people and I am ready to testify. I have spoken with other people who were imprisoned in Manjača and here at the Police Station. We are all shocked by this information. I will ask the victims' families to go to the HJPC and demand Kajganić's dismissal," said Ključanin, adding that he will not let this go and will also organize protests in front of the BiH Prosecutor's Office.

The BiH Prosecutor's Office responded to Detektor that the Chief Prosecutor designated the case as a priority and issued mandatory instructions for its completion.

"The case has not yet been concluded with a final prosecutorial decision, but the Chief Prosecutor has instructed the head of the Special Department for War Crimes to take all necessary measures to complete the work and make a prosecutorial decision. The claims that the Chief Prosecutor obstructed the investigation and prevented the filing of an indictment are not true," the Prosecutor's Office stated in its response.

The Association of Camp Inmates of Sanski Most also stated that they are considering whether to request a meeting with Chief Prosecutor Kajganić, as well as prosecutor Ivan Matešić, head of the Special Department for War Crimes at the BiH Prosecutor's Office.

The information on actions submitted to the HJPC states that Kajganić has "business and other connections with the suspect from 1992 until at least 2006, or 2010."

"Milanko Kajganić, as Chief Prosecutor, banned the submission of the filed indictment in this case to the Court of BiH, and then undertook a series of unlawful actions unauthorizedly, i.e., exceeding and abusing his authority, and outside the prescribed procedure, by deleting or ordering the deletion of data and documents, which I, as an authorized prosecutor, made and stored in the TCMS within this case, including the order to conduct an investigation and the names and surnames of the suspects," the information states, adding that Kajganić took these actions after the end of last year.

The Disciplinary Prosecutor's Office had previously dismissed a complaint against Kajganić due to lack of evidence for his statements in a television show where he commented on the prosecution of genocide denial, while a case was formed against him and prosecutor Vedrana Mijović a few months ago based on a report regarding their actions in the case against Radovan Višković, Nenad Stevandić, and Milorad Dodik for attacking the constitutional order.
