House of Representatives of the Parliamentary Assembly of Bosnia and Herzegovina on proposals for the Law on the Court of BiH and the HJPC

(Patria) - An emergency session of the House of Representatives of the Parliamentary Assembly of Bosnia and Herzegovina has been scheduled for today, with the agenda including the Proposal for Amendments to the Law on the Court of BiH and the Proposal for the Law on the High Judicial and Prosecutorial Council (HJPC) of Bosnia and Herzegovina.

The proposers of both legal solutions are MPs from the Club of SDS, PDP, For Justice and Order Darko Babalj, Branislav Borenović, Mira Pekić, Nenad Grković, and Mladen Bosić.

Both proposals will be before the MPs in the first reading, under an abbreviated procedure.

In the explanation of the Proposal for the Law on the Court of BiH, the proposers state that it is necessary to regulate the status of judges of the Appellate Division of the Court of BiH, as a second-instance body, with specially selected and permanently appointed judges by an independent regulator, and that the seat of the Appellate Division should be in Pale.

The Proposal for the Law on the HJPC of BiH states that the composition of this body will reflect the composition of the peoples of BiH in accordance with the Constitution of BiH and gender representation in BiH, while the HJPC rulebook will regulate procedures necessary to ensure compliance with the applicable provisions of the Constitution and laws of BiH governing this matter.

Explaining this legal proposal, the proposers state that it is envisaged that within one year from the date of entry into force of this law, the Parliamentary Assembly of Bosnia and Herzegovina will adopt a Law on the High Judicial and Prosecutorial Council that will be harmonized with EU standards.

These two proposals were included on the agenda of the previous session of the House of Representatives of the Parliamentary Assembly of BiH, but MPs did not accept to consider them under an urgent procedure.
