House of Representatives of FBiH: Bankruptcy Law Rejected, HDZ Dissatisfied

SARAJevo, (Patria) - After a short debate and certain amendments, the agenda for the 11th regular session of the House of Representatives of FBiH was adopted. 

The agenda will include a vote on conclusions that represent a response to the session of the National Assembly of Republika Srpska (NSRS). 

However, since those conclusions are still being printed, the Speaker of the House, Mirsad Zaimović, decided to begin the session with the consideration of the Draft Law on Bankruptcy. 

Elvir Karajbić (SDP BiH) stated that this legal solution has two major shortcomings: “that bankruptcy proceedings can again last indefinitely and that one bankruptcy trustee can simultaneously conduct multiple bankruptcy proceedings”. 

This was followed by an exchange of remarks between Karajbić and Suad Kaknjo (SDA). The former argued that the law was flawed, while Kaknjo stated that this legal solution is something completely new compared to the existing one. 

A new round of remarks was exchanged between Karajbić and Eldin Vrače (independent representative). Vrače believes that the Draft Law on Bankruptcy is “a revolutionary solution compared to the current situation”. 

Karajbić responded that the proposed law will not bring the expected improvements. 

Mujo Hasić (SDP) stated that according to certain provisions of the new law, “half of the companies in FBiH should go bankrupt”. 

After electronic and individual voting, the Draft Law on Bankruptcy did not receive support. 

The Club of the Croatian Democratic Union of Bosnia and Herzegovina (HDZ BiH) requested an individual vote, clearly dissatisfied with the fact that this law did not receive support in the electronic vote. However, the result was the same. 

Subsequently, the Draft Law on Amendments to the Law on Leasing was supported without debate.
