
(Patria) - The Attorney's Office of Bosnia and Herzegovina has requested the Municipal Court in Mostar to urgently exclude state property from the bankruptcy estate of the Oil Terminal Dretelj, after learning that Hercegovina banka d.d. Mostar in bankruptcy had scheduled a public sale of this property for August 22, 2025, BHRT reported.
At the same time, a request was submitted to the Municipal Court in Čapljina for the registration of a ban on disposal and alienation of parcels and buildings in state ownership.
The Attorney's Office of BiH warns that this case involves real estate that was previously registered as public property, which, as they state, was illegally transferred to certain legal entities, and then to Hercegovina banka d.d. Mostar in bankruptcy.
– The state of Bosnia and Herzegovina is, according to Article I, paragraph 1 of the Constitution of BiH, the legal successor of the Republic of Bosnia and Herzegovina, which under international law continues its existence as the state of BiH. This confirms the legal continuity of the state within its internationally recognized borders, and on this basis BiH claims ownership of the property of the former SFRY, as well as SR BiH – stated in the announcement of the Attorney's Office.
It is added that there is no legal basis for the transfer of ownership of state property, specifically in the case of land registry entries number 567 K.O. Dretelj and number 815 K.O. Dretelj. It is particularly emphasized that all these actions were carried out without the consent of the actual owner – the state of Bosnia and Herzegovina.
The Attorney's Office insists on urgent action by judicial authorities to prevent further alienation of state property.
