Return of Gavrankapetanović to the Health Insurance Institute of Canton Sarajevo will be attempted to be blocked, the question is which methods will be chosen

The return of Dr. Faris Gavrankapetanović to the head of the Health Insurance Institute of Canton Sarajevo will be attempted to be blocked in every possible way, despite the final verdict of the Cantonal Court in Sarajevo that Gavrankapetanović must be reinstated to his position.

The return of Dr. Gavrankapetanović to the position of director of the Health Insurance Institute of Canton Sarajevo was opposed by the cantonal prime minister Elmedin Konaković. He confirmed this during media appearances. He has tacitly approved the payment of salaries to Dr. Gavrankapetanović over the past three years, but not his return to the director's position in this institution. The return of Gavrankapetanović to the head of the Institute is also not in the interest of the current director of the Institute, Dr. Samir Turković, nor Dr. Sebija Izetbegović, director of the Clinical Center of the University of Sarajevo. It is said that Dr. Izetbegović has a strong influence on Dr. Turković. All are members of the Party of Democratic Action.

It is unquestionable that the return of Gavrankapetanović to the head of the Health Insurance Institute of Canton Sarajevo will be blocked despite the court ruling in favor of Gavrankapetanović. The only question is which methods will be used.

The former director of the Health Insurance Institute of Canton Sarajevo, Dr. Faris Gavrankapetanović, received a second-instance verdict against the Government of Canton Sarajevo, which he sued after being dismissed from the position of director of the Institute in September 2013. It turned out that the dismissal was illegal. The Cantonal Court in Sarajevo confirmed this with a final verdict. The dispute lasted a little over three years. The final verdict in favor of Dr. Gavrankapetanović was rendered on February 10 this year. It was delivered to both the Government of Canton Sarajevo and the Health Insurance Institute of Canton Sarajevo. The verdict clearly states that Gavrankapetanović is to be reinstated to the position of director of the Institute, following the illegal dismissal. The deadline for executing the verdict is usually 15 days. Allowing for the possibility that this verdict arrived at the address of the Government and the Health Insurance Institute of Canton Sarajevo with a delay of several days, the verdict in the case of Gavrankapetanović vs. the Government of Canton Sarajevo should in any case be executed by the end of the month, if the Government and the Institute were to respect the court's decision.

If Konaković does not comply with this court decision, Gavrankapetanović can request judicial enforcement of the verdict, which involves depositing his signature instead of Turković's in the court register and taking possession accompanied by court police.

Similar situations have occurred in court practice before.

A source from Patria explains that the responsibility for implementing this verdict lies with the prime minister of Canton Sarajevo, Elmedin Konaković, and not with the Government as a collective body. Failure to implement the verdict is a criminal offense. The same applies to the director of the Institute, who must enable the return of Dr. Gavrankapetanović to work.
