Schmidt's final warning to FBiH authorities on appointments

(Patria) - The Office of the High Representative in Bosnia and Herzegovina, Christian Schmidt, stated that almost a year has passed since the Decision was made to unblock the appointment of the Government of the Federation of Bosnia and Herzegovina.

Schmidt reminds that, based on his decision of April 27, 2023, Amendment CXXXI to the Constitution of the Federation will enter into force on May 1, without the need for adopting an additional normative act to ensure its legal effect.

The High Representative calls on the main political actors to bear this deadline in mind, should they have constructive proposals for improving the amendments.

Articles IV.B.5, paragraphs (1) and (2) are amended to read:

The President of the Federation shall, after consultations with the Speakers and Deputy Speakers of both Houses, the heads of clubs, and the Deputy Presidents of the Federation, appoint a candidate for Prime Minister who has credible chances of gaining support in the Parliament of the Federation. The candidate for Prime Minister is obliged to inform the President within 15 days about the formation of the Government, which, if appointed by the President of the Federation in agreement with both Deputy Presidents of the Federation in accordance with paragraph (2) of this Article, could be supported by a majority in the House of Representatives.

The Government of the Federation shall be appointed by the President of the Federation, in agreement with both Deputy Presidents of the Federation, within 30 days from the date of election of the President and two Deputy Presidents. The Government shall be elected after its appointment is confirmed by a majority vote in the House of Representatives.

New paragraphs 3 to 7 are added after paragraph 2, which read:

If the President of the Federation does not appoint the Government of the Federation in agreement with both Deputy Presidents of the Federation in accordance with paragraph (2) of this Article, the President shall have an additional 30 days to repeat the procedure prescribed by the provisions of the first two paragraphs of this Article.

If the President of the Federation again fails to appoint the Government of the Federation in agreement with both Deputy Presidents of the Federation in accordance with paragraph (3) of this Article, the Government shall be proposed by the President of the Federation in agreement with one of the Deputy Presidents of the Federation. The President shall submit the proposal to the Parliament of the Federation. This proposed Government shall be considered elected if confirmed by a majority vote in the House of Representatives, and then by a majority vote in the House of Peoples, provided that the votes against do not include three-fifths or more of the delegates in one or more clubs of representatives of the constituent peoples.

A vacancy in the Government shall be filled according to the procedure from paragraph 2 and 4 of this Article, unless otherwise determined by law.

If the Government is not elected according to paragraph (4) of this Article, the President of the Federation shall, in agreement with the Deputy Presidents of the Federation, repeat the procedure from paragraph (2) of this Article again.

If the Government is not appointed according to paragraph (6) of this Article, or if the Government appointed according to that paragraph is not confirmed by the House of Representatives, regardless of Article IV.A.16, paragraph (1), the Parliament of the Federation and the cantonal assemblies shall be considered dissolved. Early elections shall be called in accordance with the Election Law of BiH for the House of Representatives of the Federation and the cantonal assemblies. The mandates of the President and two Deputy Presidents of the Federation shall cease upon their dismissal after these early elections.

The former paragraph (3) becomes paragraph (8).”
