Political conflicts between ruling coalition parties have had the most severe consequences on the work of the BiH PA

SARAJevo, (Patria) - The Centers for Civil Initiatives, in their Report on the Work of the Parliamentary Assembly of BiH, emphasized that constant political conflicts within and between the ruling coalition parties have had the most severe consequences on the results of the work of the PA BiH.

- In the first quarter of 2018, the PA BiH adopted only 3 laws, which is one of the worst quarterly results of the PA BiH in the last 11 years. The achieved result is particularly problematic given the fact that the House of Representatives of the PA BiH planned to adopt 56 laws in 2018, and the House of Peoples almost as many.

Due to the small number of adopted laws in the observed period, the problem of the unfavorable ratio of adopted and rejected laws, for which the PA BiH is specific in our region and beyond, has come to the fore again. In the first quarter of 2018, only 3 laws were adopted, and three times more were rejected – 9. (and all 9 laws in the House of Representatives of the PA BiH, with all rejected laws proposed by deputies and delegates in the Parliamentary Assembly of BiH).

There are continuous delays in the adoption of orientation work plans for both houses of the PA BiH, and there was no exception when adopting the work plans for 2018. Instead of by the end of 2017, the Program of the House of Representatives was adopted at a session of the Collegium of the House on February 19, 2018, and the Program of the House of Peoples at a session of the Collegium of this House on March 21, 2018.

The realization of the total planned obligations of both houses of the PA BiH is quite good, but the realization of the most significant measures is extremely low. The House of Representatives, in the first quarter of 2018, realized as much as 62% of the measures from its 2018 program, and the House of Peoples 26%. However, the realization of legislative obligations is only 14% (8 out of 56) in the House of Representatives and only 6% (3 out of 50) in the House of Peoples.

In addition to delays in adopting the work program, there were also delays this time in adopting the budget of BiH institutions and BiH's international obligations for 2018. Unlike the state budget for the past year, 2017, which was adopted 16 days before the legal deadline, the Draft Law on the budget of BiH institutions and BiH's international obligations for 2018 was adopted with a one-month delay – on January 17, 2018, in the House of Representatives and on January 25, 2018, in the House of Peoples of the PA BiH, although there were no substantial changes in the budget content.

Bosnia and Herzegovina still has not adopted the document "Program for the Integration of BiH into the EU". By the Stabilization and Association Agreement, BiH authorities committed to creating and adopting this Program, but there is no necessary political will and readiness for compromise to finally adopt this important document.

This is a planning document that should very simply arrange all of Bosnia and Herzegovina's obligations in the European integration process and provide answers to the questions of who, what, and when needs to be fulfilled in the process of European integration of Bosnia and Herzegovina.

Some decisions of the Constitutional Court of BiH have been awaiting implementation by authorities at all levels in BiH for years – including the state level. As of January 31, 2018, a total of 11 decisions of the Constitutional Court of Bosnia and Herzegovina had not been implemented, of which 5 are requests for an assessment of constitutionality and 6 are cases from the appellate jurisdiction of the Constitutional Court of BiH. 4 out of 5 unimplemented decisions of the Constitutional Court of BiH, which were made based on requests for an assessment of constitutionality, relate to the obligations of the Parliamentary Assembly of BiH. Although it is an election year, the problem of systemic discrimination of BiH citizens and the violation of domestic and international laws by BiH institutions has not yet been resolved.

The Council of Ministers, with its composition, in which there are half as many women as the minimum prescribed by law, violates the Law on Gender Equality in BiH. The House of Peoples of the PA BiH continues to function without representatives of the "Others" in its composition, and as things stand, it will remain so after the general elections in BiH in October 2018, because the implementation of the judgment of the European Court of Human Rights in Strasbourg, in the Sejdić-Finci case (and other similar ones), has been pushed to the back burner, in favor of the also unsuccessful attempt to implement the decision of the Constitutional Court in the "Ljubić Case" – states the CCI Report.
