Implementation of the Law on State Property Management Begins, Bosnia and Herzegovina Still Without Official Stance

CROATIA, (Patria) - The Law on State Property Management, adopted a few days ago in the Croatian Parliament and published today in Narodne novine, will come into force in eight days. Bosnia and Herzegovina still has no official stance, although there are numerous properties on Croatian territory belonging to Bosnian companies and the state of Bosnia and Herzegovina.

Whether Bosnia and Herzegovina will lose its property under this law remains unanswered for now. Croatia can now lease them out under this law, which was not the case before.

Minister of Justice of Bosnia and Herzegovina Josip Grubeša is expected to officially visit Croatia next week to discuss this issue, and the matter will be addressed again at the next session of the Council of Ministers of Bosnia and Herzegovina.

The basis for the return of property is the Agreement on Succession of the Former Yugoslavia, or more specifically Annex G of the Agreement, which states that rights to movable and immovable property located in a successor state, to which citizens or other legal entities had rights as of December 31, 1990, will be recognized, protected, and returned by that state. The Agreement on Succession is a higher legal act than any domestic law.
