NSRS session begins, what was proposed in the conclusions

BANJA LUKA, (Patria) - A special session of the National Assembly of Republika Srpska has begun, where information on the transfer of competencies from Republika Srpska to the level of Bosnia and Herzegovina, with a proposal for conclusions – proposed by the President of the Republic, the Government of Republika Srpska, the BiH Presidency member from Republika Srpska, and the parliamentary groups of SNSD, SP, DEMOS, US, NPS, and the NDP Parliamentary Group, will be discussed;

Information on the transfer of competencies in the field of indirect taxation, with a proposal for conclusions - proposed by the President of the Republic, the Government of Republika Srpska, the BiH Presidency member from Republika Srpska, and the parliamentary groups of SNSD, SP, DEMOS, US, NPS, and the NDP Parliamentary Group;

Information on judicial institutions of Bosnia and Herzegovina, with a proposal for conclusions - proposed by the President of the Republic, the Government of Republika Srpska, the BiH Presidency member from Republika Srpska, and the parliamentary groups of SNSD, SP, DEMOS, US, NPS, and the NDP Parliamentary Group;

Information on the transfer of competencies from Republika Srpska to the level of Bosnia and Herzegovina in the field of defense and security, with a proposal for conclusions - proposed by the President of the Republic, the Government of Republika Srpska, the BiH Presidency member from Republika Srpska, and the parliamentary groups of SNSD, SP, DEMOS, US, NPS, and the NDP Parliamentary Group;

Declaration on constitutional principles - proposed by the President of the Republic, the Government of Republika Srpska, the BiH Presidency member from Republika Srpska, and the parliamentary groups of SNSD, SP, DEMOS, US, NPS, and the NDP Parliamentary Group.  

The Deputy Speaker of the NSRS, Denis Šulić, who is presiding over the NSRS, proposed that the debate be consolidated, which was accepted by the majority of deputies (48).

Following the debate, the adoption of the following conclusions regarding judicial institutions, defense and security, and indirect taxes is planned.

Conclusion regarding the information on judicial institutions of BiH

The NSRS adopts the information on judicial institutions of BiH.

The NSRS withdraws the consent given by the NSRS conclusions of February 25, 2004, to the Government of RS to sign the agreement on transferring certain competencies of the RS entity through the establishment of the HJPC BiH. The NSRS tasks the Government of RS to withdraw the consent to the agreement on transferring certain competencies of the entity through the establishment of the HJPC BiH, which was signed on March 11, 2004, by the prime ministers of both entities and on March 18, 2004, by the Minister of Justice of BiH. The NSRS tasks the Government of RS to submit the Law on the HJPC of RS for consideration and adoption by the NSRS within 6 months. The Law on the HJPC of BiH will not apply on the territory of RS from the date the Law on the HJPC of RS enters into force.

These conclusions enter into force the day after their adoption.

Conclusion regarding the Information on the transfer of competencies from RS to the BiH level in the field of defense and security

The NSRS adopts the information on the transfer of competencies from RS to the BiH level in the field of defense and security. The NSRS withdraws consent to the decision of August 30, 2005, and the decision to authorize the Government of RS to sign the agreement on the transfer of competencies from the field of defense to BiH institutions with the Government of FBiH on December 28, 2005.

The NSRS tasks the Government of RS to withdraw consent to the agreement on the transfer of competencies from the field of defense to BiH institutions signed with the Government of FBiH. The NSRS tasks the Government of RS to submit laws from the field of defense and security for consideration and adoption by the NSRS within 6 months. The Law on Defense of BiH, the Law on Service in the BiH Armed Forces, the Law on OSA, and the Law on SIPA will not apply on the territory of RS from the date the laws on defense and security of RS enter into force.

These conclusions enter into force the day after their adoption.

Conclusion regarding the information on the transfer of competencies in the field of indirect taxation

The NSRS adopts the information on the transfer of competencies from the field of indirect taxation. The NSRS withdraws the consent given by the NSRS conclusions of October 30, 2003, for the competency in the field of indirect taxation within the tax policy system to be transferred to the BiH Parliament in order to enable the consideration and adoption of the Law on the Indirect Taxation System of BiH.

The NSRS withdraws the consent given by the NSRS conclusions of October 30, 2003, to the Government of RS to conclude an agreement on competencies in the field of indirect taxation between RS and FBiH. The NSRS tasks the Government of RS to withdraw consent to the agreement on competencies in the field of indirect taxation between RS and FBiH, which was signed on December 5, 2003, in the presence of the High Representative by the prime ministers of the entities. The NSRS tasks the Government of RS to submit the Law on Value Added Tax and the Law on Excise Duties of RS for consideration and adoption by the NSRS within 6 months.

The Law on the Indirect Taxation System, the Law on Payments to the Single Account and Revenue Distribution, the Law on the Indirect Taxation Authority, the Law on Indirect Taxation Procedures, the Law on Compulsory Collection of Indirect Taxes, the Law on VAT, and the Law on Excise Duties of BiH will not apply in RS from the date the Law on Value Added Tax and the Law on Excise Duties of RS enter into force.
