Pivić: Imposed FBiH Premier Once Again Confirmed He Knows Nothing About a Matter of Vital National Interest

(Patria) - Federation MP Nezir Pivić commented on the statement given by FBiH Premier Nermin Nikšić in an interview for BHRT, in which he said that "the Troika agreed to form a working group at the level of the Council of Ministers that should work on preparing a new law on the Constitutional Court of BiH."

Pivić believes that the imposed FBiH Premier Nermin Nikšić, with that statement, once again confirmed that he knows nothing about the processes in which he participates and a matter of vital national interest.

Nikšić: If Dodik Conditions the Constitutional Court of BiH, Then There Are No More Talks

"Nikšić confirmed that 'working groups' were formed for the preparation of the Law on the Constitutional Court of Bosnia and Herzegovina. As a reminder, this is the law through which Dodik intends to get rid of foreign judges in the Constitutional Court of Bosnia and Herzegovina, the last obstacle to the secession of the smaller BiH entity.

Nikšić says the law must be 'in line with European standards' but forgets that such a law is not in line with the provisions of the Constitution of Bosnia and Herzegovina, which does not allow the status of foreign judges in the Constitutional Court of Bosnia and Herzegovina to be changed by law.

Therefore, the very agreement to form a working group for the preparation of the Law on the Constitutional Court of Bosnia and Herzegovina is contrary to the Constitution of Bosnia and Herzegovina because the result that Dodik expects from that group is in fact an unconstitutional law.

Nikšić continues with the claim that he, and allegedly the Troika, find unacceptable the provisions of the law that would introduce entity voting in the Constitutional Court of Bosnia and Herzegovina.

The Constitution of Bosnia and Herzegovina explicitly stipulates that, among other things, it is within the exclusive competence of the Constitutional Court of Bosnia and Herzegovina to adopt its own rules of procedure, which will, among other things, regulate the procedure, process and decision-making in the Constitutional Court of Bosnia and Herzegovina. Therefore, such a law would be clearly unconstitutional.

It is deeply concerning that Nikšić comes out in public with such erroneous views.

Additional concern lies in the fact that this concerns the Constitutional Court of Bosnia and Herzegovina, the most important state institution for the protection of the constitutional order of Bosnia and Herzegovina," Pivić stated on his Facebook profile.
